NOW, THEREFORE, THE PARTIES SIGNATORY HERETO DO
MUTUALLY AGREE AND COVENANT WITH EACH OTHER AS
FOLLOWS:
ARTICLE 1
short title, definitions, purposes and limitations
1.01. short title.—this compact shall be known
and may be cited as the potomac river basin compact.
1.02. definitions.--for the purpose of this
compact and of any supplemental or concurring
legislation enacted pursuant or in relation hereto,
except as may be otherwise required by the context:
(a) "basin" shall mean the area of drainage into
the potomac fiver and its tributaries and branches,
unto its confluence with the chesapeake bay at an
established line marking chesapeake bay waters between
the mean low-water mark at point lookout, maryland,
and smith's point, virginia, as the latter shall be
defined from time to time by boundary compact between
maryland and virginia;
(e) "commission" shall mean the potomac rives
basin commission created and constituted by this
compact, and "commissioner" shall mean a member of the
commission;
(c) "diversion" shall mean the transfer of water
into op out of the basin;
(d) "facility" shall mean any real or personal
property, within or without the basin, and
improvements thereof or thereon, and any and all
rights-of-way, water, water rights, plants,
structures, machinery and equipment acquired,
constructed, operated or maintained for the use of
water resources or related land uses including,
without limiting the generality of the foregoing, any
and all things and appurtenances necessary, useful or
convenient for the collection, storage, withdrawal,
diversion, release, treatment, transmission, sale or
exchange of water; or for navigation thereon; or for
the development and use of hydroelectric energy and
power; or for public recreational facilities; or for
the propagation of fish and wildlife; or to conserve
and protect the water resources of the basin or any
existing or future water supply source, or to
facilitate any other uses of them;
