CHAPTER 405
(Senate Bill 478)

AN ACT to repeal and re-enact, with amendments, Section 7-103 of Article 93 of
the Annotated Code of Maryland (1969 Replacement Volume and 1972
Supplement), title "Decedents' Estates," subtitle "Administration of the
Estate," subheading "Duties of Personal Representative; Notice of Appointment
to Heirs, Legatees and Creditors," to transfer the duty of publication from the
personal representative to the register and to clarify the language.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 7-103 of Article 93 of the Annotated Code of
Maryland (1969 Replacement Volume and 1972 Supplement), title "Decedents'
Estates," subtitle "Administration of the Estate," subheading, "Duties of Personal
Representative; Notice of Appointment to Heirs, Legatees and Creditors," be and
it is hereby repealed and re-enacted, with amendments, to read as follows;

7-103.

[A personal representative shall upon his appointment publish] THE
REGISTER SHALL, AFTER THE APPOINTMENT OF A PERSONAL
REPRESENTATIVE, CAUSE TO BE PUBLISHED a notice in a newspaper of
general circulation in the county of [his] THE appointment once a week for three
successive weeks, announcing [his] THE appointment and address OF THE
PERSONAL REPRESENTATIVE, and notifying creditors of the estate to
present their claims. [He] THE PERSONAL REPRESENTATIVE shall file or
cause to be filed with the register a certification that [he has published such notice
as required] A NOTICE HAS BEEN PUBLISHED. Such notice shall be
substantially in the following form:

TO ALL PERSONS INTERESTED IN THE ESTATE OF...........

This is to give notice that the undersigned,..... whose address

is.................................was, on............., appointed personal representative of the

estate of.............................who died on [[........................(with) (without a will).]]

............................. (with) (without) a will.

All persons having any objection to such appointment (or to the probate of the

decedent's will) shall file the same with the Register of Wills of..........

.................on or before....................(six months from the date of such

appointment).

All persons having claims against the decedent must present their claims to the
undersigned, or file the same with the said Register of Wills on or before six
months from the date of such appointment.

Any claim not so filed on or before such date, or any extension thereof
provided by law, shall be unenforceable thereafter.

effect July 1, 1973.
