Section 1 of this Act. ]]

SECTION 2. BE IT FURTHER ENACTED, That the programs and services
provided to any child authorized and funded under Sections 99, 100, 101 and 102
of Article 77 of the Annotated Code of Maryland (1969 Replacement Volume and
1972 Supplement) title "Public Education" subtitle Chapter 7. Handicapped
Children," shall remain in effect and not be diminished prior to or during the
phase-in of the plans provided for in Section 1 of this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That if any provision of
this Act or the application thereof to any person or circumstance is held invalid for
any reason, the invalidity shall not affect the other provisions or any other
application of this Act which can be given effect without the invalid provisions or
application, and to this end all the provisions of this Act are declared to be
severable.

[[SECTION 4. AND BE IT FURTHER ENACTED, That if the General
Assembly shall replace the State aid formula set forth in Section 128 of Article 77
with a new or revised formula and codify the same elsewhere than in Section 128,
the reference to Section 128 in Section 106B shall be deemed to refer to the section
or sections wherein the new or revised formula is set forth.]]

SECTION [[5]] 4. AND BE IT FURTHER ENACTED, That [[Section 1 of

this Act shall take effect July 1, 1973, and Section 2 of this Act shall take effect
July 1, 1975.]] this Act shall take effect July 1, 1973.

CHAPTER 360

(Senate Bill 807)

AN ACT to add new Sections 128A and 128B to Article 77 of the Annotated
Code of Maryland (1969 Replacement Volume and 1972 Supplement), title
"Public Education," subtitle "Chapter 9. Finance and Reports"; to repeal
Sections 128 and 129 of said article, title, and subtitle; to repeal and re-enact,
with amendments, Sections 42, 52(b), 57(c), 68(c), 68(g), 112(b), 112(c), 117(c),
117(g), 124(b), 124(c), 127, [[128(b),]] 130(b), and 131 of said article and title,
subtitles "Chapter 4. County Boards of Education," "Chapter 5. Superintendent
of Schools," "Chapter 8. Teachers," and "Chapter 9. Finance and Reports,"
respectively, to establish a new method and formula for providing State
financial assistance of public education, to change the requirements relating to
local financial support of public education, to provide for a phase-in of certain
new provisions relating to State and local support of public education, to
conform those sections of Article 77 which make reference to the program of
State aid for public education to the new program for such aid, to place the
provisions relating to density aid in a new section and to conform said
provisions to the new formula for general State financial assistance, and
generally relating to State and local support of public education.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 128A and 128B be and they are hereby added
to Article 77 of the Annotated Code of Maryland (1969 Replacement Volume and
1972 Supplement), title "Public Education," subtitle "Chapter 9. Finance and
Reports," to follow immediately after Section 128 thereof [[and that Section
128(b) of said article, title, and subtitle be and it is hereby repealed and re-enacted,
with amendments,]], and all to read as follows:
