SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 41(b-3A) of Article 2B of the Annotated Code of
Maryland (1968 Replacement Volume and 1972 Supplement), title "Alcoholic
Beverages," subtitle "General Provisions on Issue of Licenses," be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

41.

(b-3A) Notwithstanding any other provisions of this section in Baltimore City
OR BALTIMORE COUNTY, the holder of a Class B, (on sale-hotels and
restaurants) beer, wine and liquor license under this article, by making application
in the regular manner and paying the usual fee may obtain an additional Class B,
(on sale—hotels and restaurants) beer, wine and liquor license for premises used
and occupied as a bona fide restaurant, as may be defined by the rules and
regulations of the board of liquor license commissioners for Baltimore City OR
BALTIMORE COUNTY, provided that said restaurant has a minimum capital
investment of $150,000.00 FOR BALTIMORE CITY RESTAURANTS AND.
$250.000.00 FOR BALTIMORE COUNTY RESTAURANTS for restaurant
facilities, which sum shall not include the cost of land or buildings, and has a
minimum seating capacity of 125 persons. Nothing contained herein shall permit
the issuance of more than three (3) such licenses to any person, or for the use of
any partnership, corporation or unincorporated association in Baltimore City OR
BALTIMORE COUNTY. The granting of additional licenses hereunder shall be
limited and restricted to the purpose of providing alcoholic beverages for
consumption on the licensed premises only, with no off-sale privileges to be
exercised therewith.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 322
(House Bill 807)

AN ACT to repeal and re-enact, with amendments, Section 35(b) of Article 77 of
the Annotated Code of Maryland, (1969 Replacement Volume and 1972
Supplement), title "Public Education," subtitle "Chap. 4. County Boards of
Education," and to add new Section 36C to said Article, title and subtitle, to
follow immediately after Section 36B thereof; reconstituting the Board of
Education for Prince George's County, and providing for the composition,
election, tenure, duties, powers, salary, and operations of the Board and to
provide for a referendum for certain related questions.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 35(b) of Article 77 of the Annotated Code of
Maryland, (1969 Replacement Volume and 1972 Supplement), title "Public
Education," subtitle "Chap. 4. County Boards of Education," be and it is hereby
repealed and re-enacted, with amendments; and that new Section 36C be and it is
hereby added to said Article, title and subtitle, to follow immediately after Section
36B thereof, and all to read as follows:
