Montgomery County for any period of service under a
qualified retirement system for which the employee is
receiving retirement pay or for which he has received
vesting benefits.
(s) Limitation on credited service.
Notwithstanding any other provisions of this Section
or of this article, any credited service earned, given
or purchased by a member may not be used for
qualifying that member for normal retirement before he
has attained the age of forty-six (46) with at least
twenty (20) years of credited County service.
(t) Credited service for a period of prior County
service. Each present or former full—time employee of
Montgomery County before March 1, 1948 and who was
subsequently appointed to a full-time County position
on or before July 1, 1970 shall be eligible to be
credited for such period of full-time County service
pursuant to the provisions of Section 94—65 (e)
"Recredited service for period of County service", or
Section 94—65 (g) "Payment of contributions for County
service not credited under the Employees' Retirement
System of the State of Maryland". Such present or
former employee retiring on or after May 1, 1970 must
exercise this option within ninety days (90) of the
effective date of this law or immediately upon
reappointment to the County Service.
(v) Purchase of qualified part-time service
credits. Except for the part—time employees covered
under the previsions of Section 94-61(b), part-time
employees on August 15, 1965, each qualified part-time
employee employed before the effective date of the
amendments to this article is eligible to receive
retirement service credit for any period of qualified
County service or qualified service in a participating
agency provided he pays into the Employees' Retirement
System of Montgomery County not less than six percent
(6%) of the salary he earned during the period which
he wishes to have credited for retirement purposes,
plus four percent (4%) interest per annum. This
option must be exercised within ninety (90) days of
the date qualified part-time employees are approved
for coverage, or be forfeited. If a member wishes to
purchase such credited service on an extended payment
basis he must obtain the approval of the County
Personnel Board and interest of not less than six and
one—half (6 1/2%) percent per annum, as determined by
the County Personnel Board, shall be paid. A
