AN ACT to amend Chapter 2, title "Administration", of
the Montgomery County Code 1965, by repealing and
re—enacting, with amendments, Section 2-87, title
"Powers, duties and functions"; and by adding a
new Section 2-87A, title "Code of Ethics", to
follow immediately after Section 2-87 thereof to
provide for interviews of applicants for
appointment to the County Board of Appeals by the
County Council or its designee as to any possible
or potential conflict, of interests and to provide
generally for a code of ethics governing conflict
of interests pertaining to the members of the
County Board of Appeals which provides for the
disclosure of the interest of any person in any
matter before the Board and disqualification of
that person from participating in decisions or
other actions in which there exists a conflict
between his official duties and private
interests; and which provides that no member may
act as broker, agent, attorney, representative or
employee of any private interests dealing with
the County nor appear as an advocate before the
County or described agencies except in an
official capacity; and to amend Chapter 73, title
"Administration", of the Montgomery County Code
1965, as amended, by repealing and re—enacting,
with amendments, Section 73-24, title
"Application", and subsection (b) of Section
73—26, title "Disclosure and nonparticipation
required; ex parte communications", to exclude
the County Board of Appeals for Montgomery County
from the provisions of the Montgomery County Code
of Ethics.
