MONTGOMERY COUNTY
EROSION CONTROL MEASURES HAVE BEEN AND ARE BEING
EMPLOYED IN ACCORDANCE WITH A GRADING, EROSION, AND
SEDIMENT CONTROL PLAN APPROVED BY THE DISTRICT.
M. GRADING, FILLING OR EXCAVATING PURSUANT TO A
PERMIT ISSUED BY THE DEPARTMENT OF PUBLIC WORKS UNDER
SECTION 103-16 OF THE MONTGOMERY COUNTY CODE 1965, FOR
WORK IN STREETS, ROADS OR RIGHTS-OF-WAY DEDICATED TO
PUBLIC USE, PROVIDED, HOWEVER, THAT SEDIMENT AND
EROSION CONTROL MEASURES HAVE BEEN AND ARE BEING
EMPLOYED IN ACCORDANCE WITH A GRADING, EROSION, AND
SEDIMENT CONTROL PLAN APPROVED BY THE DISTRICT.
2. EXEMPTION FROM A PERMIT DOES NOT EXEMPT THE
PROJECTS LISTED IN SUBSECTIONS E., F., J., K., L. , AND
M., ABOVE, FROM OTHER PROVISIONS OF THIS CHAPTER
INCLUDING INSPECTION, BUT EXCLUDING BONDING AND
LIABILITY INSURANCE.
SECTION 83A-4. PERMIT APPLICATION.
TO OBTAIN A PERMIT AN APPLICANT SHALL FIRST FILE
AM APPLICATION THEREFOR IN WRITING UPON FORMS
FURNISHED BY THE DEPARTMENT. THE APPLICATION MUST BE
SIGNED BY THE OWNER OF THE PROPERTY, OR AN AUTHORIZED
AGENT, WHERE THE WORK IS TO BE PERFORMED. IF THE
OWNER IS A CORPORATION, IT MUST BE SIGNED BY THE
PRESIDENT OR VICE-PRESIDENT, ATTESTED BY THE SECRETARY
OR ASSISTANT SECRETARY AND THE CORPORATE SEAL AFFIXED.
THE APPLICATION SHALL BE ACCOMPANIED BY SCALE PLANS OR
DRAWINGS, INCLUDING A GRADING, EROSION AND SEDIMENT
CONTROL PLAN, IN QUADRUPLICATE, AND THE PERMIT FEE,
APPROVAL OF THE MARYLAND DEPARTMENT OF NATURAL
RESOURCES WHERE APPLICABLE, AND A BOND AS REQUIRED IN
SECTION 83A-9. THE PLANS ACCOMPANYING THE APPLICATION
SHALL BE PREPARED AND CERTIFIED BY A PROFESSIONAL
ENGINEER, LAND SURVEYOR OR ARCHITECT, OR OTHER PERSON
QUALIFIED AND APPROVED BY THE DEPARTMENT, AND SHALL
CONTAIN THE FOLLOWING:
A. A VICINITY SKETCH AND BOUNDARY LINE SURVEY OF
THE SITE FOR WHICH THE PERMIT IS SOUGHT AND OR WHICH
THE WORK IS TO BE PERFORMED;
B. LOCATION OF ANY BUILDINGS, STRUCTURES,
UTILITIES, SEWERS, WATER AND STORM DRAINS ON THE SITE
WHERE THE WORK IS TO BE PERFORMED;
C. LOCATION OF ANY BUILDING OR STRUCTURE ON LAND
OF ADJACENT PROPERTY OWNERS WITHIN ONE HUNDRED (100)
