116-2, 116-3, 116—4, 116-5 and 116-7 to provide
that the regulations pertaining to the control of
weeds and grass shall be extended throughout the
territorial confines of Montgomery County, with
exceptions; to provide for the issuance of
notices of violation of this Chapter, and to
further provide for an increase in the maximum
fine imposed by this Chapter to 3100.

SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
FOR MONTGOMERY COUNTY, MARYLAND, That Sections 116-1,
116-2, 116-3, 116-4, 116-5 and 116-7 of Chapter 116,
titled "Weeds," the Montgomery County Code 1965, are
hereby amended as follows:

Sec. 116—1. Definitions.

For the purposes of this Chapter, the following
words and phrases shall have the meanings respectively
ascribed to them by this Section:

Director. The Director of the Department of
Inspection and Licenses.

Subdivision. The division or partition of a lot,
tract or parcel of land into two or more lots, plots,
sites, tracts, parcels or other divisions for the
purpose, whether immediate or future, of rental sale
or building development, and shall include
resubdivision, but. shall not include a bona fide
division or partition of land for agricultural
purposes.

Sec. 116-2. Applicability of Chapter.

The provisions of this Chapter shall be effective
throughout Montgomery County except in incorporated
towns, unless this Chapter is adopted by the
incorporated town and the County Council is requested
and agrees to enforce this Chapter within such
incorporated town pursuant to Section 2-25 of this
Code.

Sec. 116—3. Duty of property owners, occupants,
lessees and agents to cut.

It shall be the duty of every owner, occupant,
lessee or agent in charge of land lying in any
subdivision within Montgomery County to keep all weeds
