AN ACT To amend Chapter 13, title, "Jail and
Prisoners," of Montgomery County Code 1965, as
amended, by repealing and re—enacting with
amendments. Sections 13—1 through Section 13-10
to change description of "jail" to "detention
center", "prisoner" to "inmate", "warden or
jailer" to "correctional administrator", and
"county manager" to "Chief Administrative
Officer", and to provide for a mandatory medical
examination for all prisoners.
SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
FOR MONTGOMERY COUNTY, MARYLAND, That Chapter 13,
title "Detention Center and Inmates", of the
Montgomery County Code 1965 is hereby repealed and
re—enacted, with amendments, to read as follows:
Sec. 13—1. Inmates-—Work on public
property—Generally.
In any sentence of confinement in the county
detention center, by the circuit court or the people's
court having criminal jurisdiction, any male inmate
over sixteen years of age unless excused by the court,
shall be subject to perform work during the period of
his imprisonment (1) in the county detention center or
(2) on the public roads or other public property of
the county or (3) on the public roads or other public
property of the State of Maryland within the county or
(4) in the event of community disasters or
emergencies, or (5) in any special taxing area in the
County; provided, that, for such work on the public
streets or other public property of the State of
Maryland or of a special taxing area, the authorities
of the special taxing area or the State of Maryland
shall, by agreement with Montgomery County, be charged
with the expense which may attend such employment.
