COUNTY LOCAL LAWS
AN ORDINANCE to repeal and re—enact, with amendments,
Sections 14-303 (a), (b) (1) and (c) (4) and
14-308 (a) (2) and (3), and (a) (5) (i) of the Anne
Arundel County Code (1967 Edition and
Supplement), Title 14, "Police," Subtitle 3,
"Police and Fire Service Retirement"; and to
repeal Section 14-303(e) of said Code, Title and
Subtitle, and to enact new Section 14—303 (e) in
lieu thereof, to stand in the place of the
section repealed; respectively to change certain
requirements of the Police and Fire Service
Retirement as a prerequisite for qualifying for
total and permanent disability, to change certain
eligibility requirements for disability pension
under said retirement, to change the amount of
disability pension in the event of cessation of
such pension, [[and]] to change the annual amount
of disability pension payable to each eligible
participant, respectively, TO MAKE THE PROVISIONS
OF THIS ORDINANCE APPLICABLE__TO__EMPLOYEES
RECEIVING DISABILITY BENEFITS ON THE EFFECTIVE
DATE OF THIS ORDINANCE; and matters generally
related thereto.
SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
OF ANNE ARUNDEL COUNTY, MARYLAND, That Sections
14-303 (a), (b) (1) and (c) (4) and 14-308 (a) (2) and
(3) , and (a) (5) (i) of the Anne Arundel County Code
(1967 Edition and Supplements), Title 14, "Police,"
Subtitle 3, "Police and Fire Service Retirement," be
and they are hereby repealed and re—enacted, with
amendments, to read as follows:
Section 14-303
(a)(1) Total and permanent disability. A
participant shall be deemed to be totally and
permanently disabled when on the basis of a medical
examination by a physician or physicians selected by
the county, the [[personnel officer finds him]] THE
PARTICIPANT IS FOUND:
[ (1) ] (I) To be wholly and permanently prevented
from engaging in any occupation or employment for
remuneration or profit as a result of bodily injury or
disease [whether occupational or nonoccupational in
cause], or
[ (2) ] (II) To be wholly and permanently
prevented, AS A RESULT OF BODILY INJURY OR DISEASE,
