AN ORDINANCE to amend the Charter of Anne Arundel
County, Maryland, by repealing and re-enacting,
with amendments, Section 712 thereof, Article
VII, "Budgetary and Fiscal Procedures", to change
the procedures for making supplementary and emer-
gency appropriations, to require such
appropriations to be acted upon on a legislative
day, and matters generally related thereto; and
to submit said amendment to the qualified voters
of Anne Arundel County for their adoption or
rejection.
SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
OF ANNE ARUNDEL COUNTY, MARYLAND, That Section 712 of
the Charter of Anne Arundel County, Maryland, Article
VII, "Budgetary and Fiscal Procedures" be, and it is
hereby repealed and re—enacted, with amendments, to
read as follows:
Section 712. Supplementary and emergency
appropriations.
[(a) Supplementary.] During any fiscal year,
the County Council, upon the recommendation of the
County Executive may by ordinance make additional [or]
, supplementary, OR EMERGENCY appropriations from
CONTINGENT FUNDS, FROM REVENUES RECEIVED FROM
ANTICIPATED SOURCES BUT IN EXCESS OF BUDGET ESTIMATES
THEREFOR, OR FROM REVENUES RECEIVED FROM SOURCES NOT
ANTICIPATED IN THE BUDGET FOR THE CURRENT FISCAL YEAR
[unexpended and unencumbered funds set aside for
contingencies in the County budget,]; provided that
the Controller shall first certify in writing that
such funds are available for such appropriation. No
supplemental appropriations shall exceed the amount of
the funds so certified.
[ (b) Emergency. To meet a public emergency
affecting life, health or property, the County Council
may, upon recommendation of the County Executive, by
ordinance, make emergency appropriations from
contingent funds, from revenues received from
anticipated sources but in excess of the budget
estimates therefor, or from revenues received from
sources not anticipated in the budget for the current
fiscal year.] To the extent that there may be no
