adjoining the present Southerly corporate boundary, to-wit:

Beginning at a point in the West marginal line of Frederick Street, said point
being at the intersection of the South 72 degrees 52 minutes 30 seconds East
4913.45 foot line of the existing Corporate Boundary and running thence with the
said existing Corporate Boundary North 72 degrees 52 minutes 30 seconds West
1769.11 feet, thence leaving the said existing Corporate Boundary South 11 degrees
37 minutes 25 seconds West 72.44 feet to an iron pin, thence North 78 degrees 22
minutes 41 seconds West 913.57 feet, thence South 9 degrees 43 minutes 51
seconds West 628.14 feet, thence South 76 degrees 17 minutes 57 seconds East
115.50 feet, thence South 48 degrees 03 minutes 52 seconds East 845.61 feet,
thence South 84 degrees 49 minutes 42 seconds East 340.57 feet, thence South 20
degrees 26 minutes 40 seconds West 381.57 feet, thence South 73 degrees 19
minutes 36 seconds East 1263.56 feet to a locust tree, thence North 7 degrees 45
minutes 42 seconds West 331.78 feet to an iron pin, thence North 6 degrees 50
minutes 32 seconds West 442.42 feet, thence North 76 degrees 07 minutes 30
seconds East 485.32 feet, thence North 13 degrees 51 minutes 39 seconds West
230.30 feet, thence South 78 degrees 22 minutes 41 seconds East 306.24 feet to the
said West marginal line of Frederick Street, thence crossing said street North 76
degrees 06 minutes 50 seconds East 66.00 feet to the East marginal line thereof,
said East marginal line also being a portion of the existing Corporate Boundary,
thence with said existing Corporate Boundary and East marginal line of Frederick
Street North 13 degrees 54 minutes West 250.85 feet, thence leaving the east
marginal line of Frederick Street but still running with a portion of the existing
Corporate Boundary North 72 degrees 52 minutes 30 seconds West 77.01 feet to
the point of beginning, containing 65.46 acres of land, more or less. Said tract of
land being also shown in outline upon the Plat dated January 10, 1972, which is on
file in the Office of the City Engineer of The City of Hagerstown, bearing Drawing
Number 83-348-01; and

WHEREAS, The proposal to enlarge the corporate boundaries of The City of
Hagerstown by adding or annexing thereto the above described area which adjoins
the present Southerly Corporate Boundary, is contained in a petition signed by
Fridinger Company, Inc. as the owner of all of the real estate within said area; and

WHEREAS, The Mayor has caused to be made a verification of the signature
on said petition and has ascertained that no person resides in the area proposed to
be annexed and consequently there are no registered voters in county elections in
the precinct or precincts in which the said area is located, as will appear from the
certificate of verification subscribed by Thurston A. Keltner, which certificate was
presented at this meeting.

SECTION 1. NOW, THEREFORE, BE IT RESOLVED by the Council of
The City of Hagerstown that the corporate boundaries of The City of Hagerstown
be and the same are hereby enlarged by adding or annexing thereto the area
adjoining the present Southerly corporate boundary as particularly described in the
title to this Resolution;

SECTION 2. AND BE IT FURTHER RESOLVED, That the conditions and
circumstances applicable to the change in said corporate boundaries and to the
residents and property within the area so annexed, are as follows:

(a) That the persons hereafter residing in the area to be annexed and all
property located therein shall be generally subject to the provisions of the Charter
of The City of Hagerstown, without special treatment as to the rates of municipal
taxation or as to municipal services and facilities.
