RESOLUTION NO. 8-72

A RESOLUTION TO PROPOSE AN AMENDMENT TO ARTICLE I,
SECTION 2 OF THE CHARTER OF THE CITY OF FREDERICK,
ENTITLED "INCORPORATION IN GENERAL GOVERNMENT";
SUBTITLED "BOUNDARIES", TO PROVIDE FOR THE ANNEXATION
OF 133.828 ACRES OF LAND, MORE OR LESS, IN THE CORPORATE
LIMITS OF THE CITY OF FREDERICK.

BE IT RESOLVED, ENACTED AND ORDAINED by the Mayor and Board
of Aldermen of the City of Frederick that the Charter of the City of Frederick, as
the same was enacted by the General Assembly of Maryland in Chapter 557 of the
Laws of 1953, be amended in Article I, Section 2, as follows:

Article I. INCORPORATION AND GENERAL GOVERNMENT.
Section 2. BOUNDARIES.

The taxable corporate limits of the City of Frederick shall be as follows:
Beginning at Stone No. 1, standing on the northern side of West Seventh Street,
said stone being on the northerly extension of a line 10.0 feet westerly of the
easternmost side of Military Road and running thence on bearing based on the
coordinate system established by the Bureau of Controls and Surveys of the State
of Maryland, (1) S. 44°01' 06" West 2,984.06 feet to Stone No. 2, said Stone No.
2 being on the southerly extension of said line 10.0 feet westwardly of easternmost
side of Military Road and 5.35 feet northward, measured at right angles from the
centerline of the old H & F Railway along Rosemont Avenue formerly called
West Fourth Street; thence (2) N. 24°41' 54" W. 1197.25 feet to Stone No. 3
standing on the northernmost side of the old H & F Railway, 5.35 feet measured
at right angles from the centerline of said railway and being also 78.1 feet,
measured along said railway, southeasterly from the centerline of the main
entrance driveway to the County Home known as Montevue; thence along the
eastern side of West Fourth Street five courses and distances (3) North 24 °41' 54"
West 1468.81 feet to point No. W4; thence (4) North 20° 18' 33" West 849.21
feet to point No. W5 opposite and 40 feet from centerline station 71+51.45 on State
Roads Commission Right of Way Plat 17054; thence by a curve to the right with
radius equal to 1356.81 feet for a curved distance equal to 1170.88 feet and
subtended by a chord bearing (5) N. 4 °24' 47" East 1134.89 feet to point No. W6;
(6) thence North 29 °08' 07" East 491.65 feet to point No. W7 opposite and 40 feet
from centerline station 54+54.40 on State Roads Commission Right of Way Plat
17052; thence by a curve to the left with radius equal to 4623.66 feet for a curved
distance equal to 2378.28 feet and subtended by a chord bearing (7) N. 14 °23'
58.5" E. 2352.15 feet to an iron pipe No. W8, at a corner common to lots 4 and 5
on Plat No. 1 of "West Hills" recorded in Frederick County Plat Book 3, Folio
182; thence to exclude the property on Plat No. 3A of "West Hills" recorded in
Frederick County Plat Book 5, Folio 81, eight courses and distances (8) N. 83 °32'
