2190                                    MUNICIPAL CHARTERS

AMENDING SECTION 22-50 OF THE CITY CHARTER

TITLE - An amendment of the City Charter to provide that the taxes provided for
in Section 22-48 of the City Charter when overdue shall bear interest while in arrears
at the rate of two-thirds of one percentum (2/3%) per month or fraction of a month
until paid instead of the one-half of one percentum (0.5%) for each month or fraction
of a month as now provided and adding in addition thereto a penalty of one-half of
one percentum (0.5%) per month or fraction of a month while such taxes are in
arrears.

SECTION 1. BE IT RESOLVED BY THE MAYOR AND
COMMISSIONERS of the City of District Heights, Prince George's County,
Maryland, pursuant to the authority of Article 23 Section 12 of the Annotated
Code of Maryland, 1957 Edition as amended, that Section 22-50 of the present
Charter of the City of District Heights, as adopted January 20, 1962, be amended
by deleting therefrom the provision that the taxes provided for in Section 22-48 of
the Charter when overdue shall bear interest at the rate of lone-half of one
percentum per month for each month or fraction of a month until paid],
substituting therefor the provision that such taxes when overdue shall bear interest
at the rate of TWO-THIRDS OF ONE PERCENTUM PER MONTH (2/3%)
per month or fraction of a MONTH UNTIL PAID and adding the provision
THAT THERE SHALL BE IMPOSED A PENALTY IN ADDITION
THERETO OF ONE-HALF PERCENTUM PER MONTH OR FRACTION
OF A MONTH UNTIL PAID.

SECTION 2. BE IT FURTHER RESOLVED that Section 22-50 of the
Charter shall read as follows: THE TAXES PROVIDED FOR IN SECTION
22-48 OF THIS CHARTER SHALL BE DUE AND PAYABLE ON THE
FIRST DAY OF JULY IN THE YEAR FOR WHICH THEY ARE LEVIED
AND SHALL BE OVERDUE AND IN ARREARS ON THE FIRST DAY OF
THE FOLLOWING OCTOBER. THEY SHALL BEAR INTEREST WHILE
IN ARREARS AT THE RATE OF TWO-THIRDS OF ONE PERCENTUM
PER MONTH (2/3%) OR FRACTION OF A MONTH UNTIL PAID AND
THERE SHALL BE IMPOSED IN ADDITION THERETO A PENALTY OF
ONE-HALF OF ONE PERCENTUM (0.5%) PER MONTH OR FRACTION
OF A MONTH UNTIL PAID. ALL TAXES NOT PAID AND IN ARREARS
AFTER THE FIRST DAY OF THE FOLLOWING JULY SHALL BE
COLLECTED AS PROVIDED IN SECTION 22-51.

SECTION 3. BE IT FURTHER RESOLVED that the date of adoption of this
Resolution shall be July 7, 1972 and the amendment to the Charter shall become
effective on the 26th day of August 1972, unless a proper petition for referendum
hereon shall be filed as permitted by law, provided a complete and exact copy of
this Resolution shall be continuously posted on the bulletin board in the District
Heights Municipal Center until August 17, 1972 and provided further that a copy
of the title and a summary of this Resolution or a complete copy of this
Resolution shall be published in the "Enquirer-Gazette," a newspaper of general
circulation within the City of District Heights, Maryland, or in any other
newspaper of general circulation within the City once in each of the weeks
beginning July 9, 1972, July 16, 1972, July 23, 1972 and July 30, 1972.

SECTION 4. AND BE IT FURTHER RESOLVED that the Mayor is hereby
specifically enjoined to carry out the provisions of paragraph 3 hereof and, as
evidence of such compliance, the Mayor shall cause to be affixed to the minutes of
this meeting an appropriate certificate of publication of the newspaper in which the
title and summary of this Resolution shall be published and shall declare the
amendment to the Charter hereby enacted to be effective by affixing his signature
hereto in the space provided for that purpose.
