RESOLUTION OF THE
MAYOR AND ALDERMEN OF THE
CITY OF ANNAPOLIS
TO REPEAL AND RE-ENACT
SECTION 28 - OF THE CITY CHARTER
Resolution of the Mayor and Aldermen of the City of Annapolis, adopted
pursuant to the authority of Article 11-E of the Constitution of the State of
Maryland and Article 23-A of the Annotated Code of Maryland (1966
Replacement Volume), titled "Corporations-Municipal", to repeal and re-enact
Section 28 of the Charter of the City of Annapolis for the purpose of creating a
Medical Review Board, its composition, purposes relating to determining the
continued existence of occupational and non-occupational disability retirements,
requirements to make recommendations to the Mayor and Aldermen; deletion
from retirement benefits due to earnings of retiree, cessation of benefits of retiree
under certain circumstances, and all matters relating generally.
SECTION I: BE IT RESOLVED BY THE MAYOR AND ALDERMEN OF
THE CITY OF ANNAPOLIS that Section 28 of the Charter of the City of
Annapolis be, and the same is hereby repealed and re-enacted to read as follows:
Sec. 28. Policemen and firemen retirement review.
An impartial Medical Review Board shall make recommendations to the mayor
and aldermen for granting occupational and non-occupational disability
retirements from the police and fire departments. The board, comprised of three
(3) city residents appointed by the mayor and aldermen of the City of
Annapolis, shall review the medical examination reports by two (2) physicians
other than the City health officer or the employee's physician; the two
physicians to be selected by the mayor and aldermen of the City of Annapolis.
The Medical Review Board shall implement the following policies:
1. Require a medical examination annually for the first five (5) years of
occupational and non-occupational disability retirements; thereafter the City will
presume the employee will remain disabled for life.
2. Require a report of total earnings when requested by the City; substantiated
with documents of the earnings reported, including federal income tax reports;
the report of earnings to be filed with the board in January for the preceding
