normal disability (occupational and non-occupational) retirements, retirement
salaries, and all matters relating generally.
SECTION I: BE IT RESOLVED BY THE MAYOR AND ALDERMEN OF
THE CITY OF ANNAPOLIS that Section 27 of the Charter of the City of
Annapolis be, and the same is hereby repealed and re-enacted to read as follows:
Sec. 27. Retirement of policemen and firemen.
NORMAL RETIREMENT. If a member of the police department or fire
department is hired after August 1, 1972, he shall be eligible for retirement from the
department after twenty years of service and attaining age fifty-five (55). The
annual retirement income shall be equal to two per cent (2%) of his last annual
salary for each year of active service up to a maximum of sixty per cent (60%) for
thirty (30) or more years.
If a member of the police department or fire department is hired on or after
August 1, 1967, having less than five (5) years active service, he may elect the
following:
1. He may, at the sole determination of the mayor and aldermen, be retired
from the department after twenty (20) years of active service, on an annual
retirement income equal to two per cent (2%) of his last annual salary for each year
of active service up to a maximum of sixty per cent (60%) for thirty (30) or more
years. There shall be no provisions in the law under which a member of the
department may apply for retirement or be retired at a certain age limit.
2. He shall be eligible for retirement from the department after twenty (20)
years of service and attaining age fifty-five (55), on an annual retirement income
equal to two per cent (2%) of his last annual salary for each year, up to a maximum
of sixty per cent (60%) for thirty (30) years or more of active service.
If a member of the police department or fire department was hired prior to
August 1, 1967, he may, at the sole determination of the mayor and aldermen, be
retired from the department after twenty (20) years of active service, on an annual
retirement salary equal to two per cent (2%) of his last annual salary for each year
of active service up to a maximum of sixty per cent (60%) for thirty (30) years or
more of active service. There shall be no provisions in the law under which a
member of the department may apply for retirement or be retired at a certain age
limit.
Each retired member under all of the aforegoing provisions shall receive the
benefit of any raises in the pay scale for members of the same rank and years of
service who are on active duty.
DISABILITY RETIREMENT (OCCUPATIONAL). If a member of the police
department or fire department is permanently incapacitated from active service
by accident in line of duty, which accident shall occur less than twenty-five (25)
years of active service, the employee's retirement pay shall be fifty per cent
(50%) of his annual salary at the date of his retirement. A member eligible for
occupational disability retirement benefits with more than twenty-five (25) years
of active service shall receive benefits equal to two per cent (2%) of his annual
salary at the date of his retirement for each year of active service, increasing to
a maximum of sixty per cent (60%) for thirty (30) or more years.
