MARVIN MANDEL, Governor                                 1919

House Bill No. 594 - Errors in Laws Concerning Appeals

AN ACT to repeal and re-enact, with amendments, Sections 5A and 12 of Article
5 of the Annotated Code of Maryland (1968 Replacement Volume and 1972
Supplement), title "Appeals." subtitle "Appeals to Court of Appeals and Court
of Special Appeals," subheadings, respectively, "Jurisdiction of the Court of
Appeals and Court of Special Appeals," and "Appeals in Criminal Cases";
correcting certain errors in the laws relating to appeals.

June 1, 1973.

Honorable Thomas Hunter Lowe
Speaker of the House of Delegates
State House
Annapolis, Maryland 21404

Dear Mr. Speaker:

In accordance with Article II, Section 17, of the Maryland Constitution, I
have today vetoed House Bill 594.

This bill repeals and re-enacts Sections 5A and 12 of Article 5 of the
Annotated Code of Maryland and corrects certain errors in the laws relating to the
appellate jurisdiction of the Court of Appeals.

House Bill 775, which was enacted by the General Assembly and signed by
me on April 26, 1973, repeals Sections 5A and 5B of Article 5, and enacts new
Sections 5A through 5D, re-allocating appellate jurisdiction between the Court of
Appeals and Court of Special Appeals.

Because of the inconsistency between House Bill 594 and House Bill 775, and
because the enactment of House Bill 775 renders House Bill 594 unnecessary, I
have decided to veto House Bill 594.

Sincerely,

/s/ Marvin Mandel
Governor
