for any refusal to take the test. Thus, the applicant would expressly agree, in
pertinent part, "that the Motor Vehicle Administration shall suspend my license ...
. upon receipt of a sworn statement from the detaining officer ..... that I ...
refused to take the chemical test for alcohol." Similar amendments would be made
in §6-205.1 (b), relating to the implied consent of nonresidents and unlicensed
persons, and in §6-205.1(c), relating to the duty of a police officer to advise a
suspect of the penalties for refusing to take the test. On the other hand, the
language of §6-205.1(d), which contains the provisions relating to suspension
hearings, would continue, albeit inconsistently, to imply that the suspension
requirement is not absolute. Thus, for example, it would provide for a suspension
only if it is concluded that the operator refused, "without reasonable cause", to
take the test. This qualified language is incompatible with that elsewhere contained
in the section and in the operator's contract with the State.
Because of its internal inconsistencies, I have decided to veto Senate bill 507.

Senate Bill No. 641 - Board of Boiler Rules
AN ACT to repeal and re-enact, with amendments, Section 169 of Article 48 of
the Annotated Code of Maryland (1971 Replacement Volume), title
"Inspections," subtitle "Boiler Safety Act," to transfer the Board of Boiler
Rules to the Division of Labor and Industry.

Dear Mr. President:
In accordance with Article II, Section 17, of the Maryland Constitution, I have
today vetoed Senate Bill 641.
This bill places the Board of Boiler Rules within the Division of Labor and
Industry.
Senate Bill 996, which was enacted by the General Assembly and signed by me
on May 24, 1973, accomplishes the same purposes as Senate Bill 641, in addition
to amending several other provisions of the Boiler Safety Act.
Therefore, it is unnecessary for me to sign Senate Bill 641.
