AN ACT to add new Section 649(a)(2-2) to Article 43 of the Annotated Code of
Maryland (1971 Replacement Volume), title "Health," subtitle "Sanitary
Districts," to follow immediately after Section 649(a)(2-l) thereof, to provide
for certain terms for members of the Sanitary Commission in Charles County;
that members of the Commission receive no payment for work or expenses
relating to their duties unless approved by the County Commissioners, to forbid
certain persons from acting in a certain capacity under certain circumstances,
and that the members of the Commission hold no other positions with the
Commission and make full disclosures regarding any Commission-related
matters in which they have a business interest.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 649(a)(2-2) be and it is hereby added to Article
43 of the Annotated Code of Maryland (1971 Replacement Volume), title
"Health," subtitle "Sanitary Districts," to follow immediately after Section
649(a)(2-l) thereof and to read as follows:
649.
(a)(2-2) THE CHARLES COUNTY SANITARY COMMISSION SHALL
HAVE THREE MEMBERS, WITH FOUR YEAR TERMS OF OFFICE. THE
FOUR YEAR TERMS SHALL COMMENCE WHEN THE TERMS OF THE
PRESENT COMMISSIONERS IN OFFICE EXPIRE, RESPECTIVELY, IN
1973, 1975 AND 1977.
MEMBERS OF THE COMMISSION SHALL HOLD NO OTHER OFFICE
WITH THE COMMISSION WHILE IN OFFICE.
MEMBERS SHALL RECEIVE NO COMPENSATION FOR DUTIES OR
EXPENSES UNLESS APPROVAL OF THE COUNTY COMMISSIONERS
IS GRANTED.
UPON TAKING OFFICE AND WHEN NECESSARY THE MEMBERS
OF THE COMMISSION SHALL MAKE PUBLIC ANY INVOLVEMENT IN
SEWERAGE OR WATER MATTERS IN CHARLES COUNTY IN WHICH
THEY HAVE A BUSINESS INTEREST.
IN ALL PROCEEDINGS BEFORE THE CHARLES COUNTY
SANITARY COMMISSION, THE ATTORNEY FOR THE CHARLES
COUNTY SANITARY COMMISSION OR ANY MEMBER OF THAT
ATTORNEY'S LAW FIRM, SHALL NOT BE THE ATTORNEY FOR ANY
PARTY OR PARTIES HAVING BUSINESS BEFORE THE COMMISSION
IN REGARD TO COUNTY WATER AND SEWAGE MATTERS.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
