SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 802
(House Bill 780)

AN ACT to repeal Subsection (a) of Section 129 of Article 66C of the Annotated
Code of Maryland (1970 Replacement Volume and 1972 Supplement), title
"Natural Resources," subtitle "Birds, Game and Fish," subheading "Hunter's
License," and to enact new Sections 125A and 125B of Article 66C of the
Annotated Code of Maryland (1970 Replacement Volume and 1972
Supplement), title "Natural Resources," subtitle "Birds, Game and Fish,"
subheading "Department of Game and Inland Fish," to follow immediately
after Section 125 of the Article providing that funds received by the Treasurer
from sport fishing license and stamp fees shall be credited to a separate fund,
known as the "State Fisheries Management and Protection Fund" and that
funds received by the Treasurer from hunting license fees shall be credited to a
separate fund, known as the "State Game Management and Protection Fund."

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Subsection (a) of Section 219 of Article 66C of the
Annotated Code of Maryland (1970 Replacement Volume and 1972 Supplement),
title "Natural Resources," subtitle "Birds, Game and Fish," subheading "Hunter's
License," be and it is hereby repealed, and that new Sections 125A and 125B of
Article 66C of the Annotated Code of Maryland (1970 Replacement Volume and
1972 Supplement), title "Natural Resources," subtitle "Birds, Game and Fish,"
subheading "Department of Game and Inland Fish," be and they are hereby
enacted to stand in the stead of the subsection repealed, to follow immediately
after Section 125 of the Article, and to read as follows:

129.

[(a) The clerks of the circuit courts of the counties and the clerk of the Court of
Common Pleas of Baltimore City shall on the first day of July and on the first day
of each and every month thereafter, transmit to the Department all moneys
received by them for licenses issued under the provisions of this subtitle, and said
moneys shall be accounted for by the said Department to the Treasurer. The
amounts so received by the Treasurer shall be placed to the credit of a separate
fund to be known as "the State Game Protection Fund," and shall be paid by the
Treasurer on warrant of the Comptroller upon requisition of the Department. The
moneys in said fund shall be used solely for scientific investigation and the
protection and management of birds, wild fowl, inland fish, and game.]

125A.

(A) THE STATE FISHERIES MANAGEMENT AND PROTECTION
FUND IS CREATED WITHIN THE DEPARTMENT OF NATURAL
RESOURCES. ANY MONEY ACCRUING TO THE FUND FROM SPORT
FISHING LICENSE AND STAMP FEES SHALL BE CREDITED TO THIS
FUND AND USED ONLY FOR THE SCIENTIFIC INVESTIGATION,
PROTECTION, PROPAGATION,. AND MANAGEMENT OF [[TIDAL
AND]] NON-TIDAL FINFISH.
