Ch. 744                          MARVIN MANDEL, Governor                               1571

dealer to sell, dispose, barter, deal in, deliver, give away, show or offer for sale any
motor vehicle or any certificate of title for any motor vehicle on Sunday. [As to
Harford County, §§ 511, 512, 513 and 514 of this article (as amended from time
to time) are specifically not affected by this section.]

(i) The State's Attorney of Wicomico County [or of Harford County, as the
case may be,] may petition the Circuit Court to enjoin any violation of this
section.

(j) Any person, firm, or corporation violating the provisions of this section is
guilty of a misdemeanor and, upon conviction, is subject to the following penalties.
The first conviction is punishable by a fine not to exceed five hundred dollars
($500.00), a second conviction is punishable by a fine not to exceed one thousand
dollars ($1,000.00), for each employee caused, directed, permitted or authorized to
work in violation of this section. Nothing contained herein shall be construed to
permit any fine upon any employee or agent who has been caused or directed by
his employer to violate the provisions of this section.

(A)  IN HARFORD COUNTY, EXCEPT AS SPECIFICALLY PROVIDED
HEREIN, IT IS UNLAWFUL ON SUNDAY FOR ANY PERSON, FIRM,
PARTNERSHIP, OR CORPORATION TO CONDUCT BUSINESS FOR
PROFIT IN THE USUAL MANNER AND LOCATION OR TO OPEN AN
ESTABLISHMENT TO THE GENERAL PUBLIC, OR TO CAUSE, DIRECT,
PERMIT, OR AUTHORIZE AN EMPLOYEE OR AGENT TO ENGAGE IN
OR CONDUCT BUSINESS OR OPEN AN ESTABLISHMENT IN THAT
MANNER.

(B)   NOTHING IN THIS SECTION APPLIES TO THE SALE OF THE
FOLLOWING ITEMS:

1.  ALCOHOLIC BEVERAGES REGULATED UNDER ARTICLE 2B.

2.  FOOD AND DRINK PREPARED FOR CONSUMPTION ON OR OFF
THE PREMISES.

3.   NEWSPAPERS, MAGAZINES STATIONERY ITEMS, GREETING
CARDS, PAPERBACK BOOKS, FILM AND CAMERA SUPPLIES,
COSMETICS AND BEAUTY AIDS, HOSIERY. BABY NEEDS, TOBACCO
PRODUCTS, CANDY, DRUGS, PATENT MEDICINES, AND PERSONAL
HYGIENE AND MEDICAL NEEDS AND SUPPLIES.

4.   GROCERIES AND OTHER CONSUMABLE ITEMS SOLD IN A
RETAIL ESTABLISHMENT REGULARLY PROVIDING EMPLOYMENT
TO NO MORE THAN FOUR (4) PERSONS INCLUDING THE OWNERS,
PROPRIETORS, OR MANAGERS OF THE ESTABLISHMENT ON. ANY
ONE SHIFT.

5.   GASOLINE, OIL, AND OTHER AUTOMOTIVE MAINTENANCE
AND REPAIR ITEMS AND SERVICES SOLD IN A SERVICE STATION
OR IN AN ESTABLISHMENT OTHERWISE PERMITTED TO CONDUCT
BUSINESS UNDER THIS SECTION.

6.   EMERGENCY REPAIR SERVICES [[,]] TO REAL PROPERTY,
INCLUDING MATERIALS REQUIRED FOR SUCH REPAIRS.

(C) NOTHING IN THIS SECTION APPLIES TO THE FOLLOWING
TYPES OF BUSINESS OPERATIONS:
