responsibility for clean-up and restoration of the natural resources of the State
and liability for environmental value of fish killed; and further providing for
other matters generally related thereto.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That subsections (b) and (e) of Section 24, subsections (b) and (i)
of Section 25 and the subheading thereof, the subheading of Section 26, subsection
(a) of Section 27, and subsections (a) and (b) of" Section 29D of Article 96A of the
Annotated Code of Maryland (1964 Replacement Volume and 1972 Supplement),
title "Water Resources", subtitle "Pollution Abatement", be and they are hereby
repealed and re-enacted, with amendments; and that subsections (c) and (d) of
Section 24, subsections (a) and (b) of Section 26, subsection (b) of Section 27,
subsections (a), (b), (c) and (d) of Section 28A of the same Article, Code, title and
subtitle be and they are hereby repealed and that new subsections (c) and (d) to
Section 24, new subsections (a) and (b) to Section 26, new subsection (b) to
Section 27 and new subsections (a), (b), (c) and (d) to Section 28A are hereby
enacted in lieu thereof, to stand in the place of the subsections repealed; and that
Section 29C of the same Article, Code, title and subtitle be and it is hereby
repealed; and that new subsections (g), (h), (i), (j), (k), (l), (m) and (n) are hereby
added to Section 24 of the same Article, Code, title and subtitle and to follow
immediately after existing subsection (f) of Section 24 thereof; and that new
subsections (c), (d), (e), (f), (g), (h), (i), (j), (k) and (1) to Section 26 of the same
Article, Code, title and subtitle and to follow immediately after new subsection (b)
of Section 26 thereof; and that new subsection (c) is hereby added to Section 27 of
the same Article, Code, title and subtitle and to follow immediately after new
subsection (b) of Section 27 thereof and that new subsections (e), (f), (g), (h) and
(i) are hereby added to Section 28A of the same Article, Code, title and subtitle
and to follow immediately after new subsection (d) of Section 28A thereof; and all
to read as follows:

24.

For the purposes of this subtitle, the following words and phrases shall have the
following meanings:

(a)    "Pollution" means such contamination or other alteration of the physical,
chemical or biological properties, of any waters of the State, including change in
temperature, taste, color, turbidity, or odor of the waters, or such discharge or
deposit of any organic matter, harmful organisms, liquid, gaseous, solid,
radioactive, or other substance into any waters of the State as will render such
waters harmful, detrimental, or injurious to public health, safety or welfare, or to
domestic, commercial, industrial, agricultural, recreational, or other legitimate
beneficial uses, or to livestock, wild animals, birds, fish or other aquatic life.

(b)     ["Wastes"] "POLLUTANT" means [industrial wastes] ANY WASTES
OR WASTEWATERS DISCHARGED FROM ANY PUBLICLY OWNED
TREATMENT WORKS OR INDUSTRIAL SOURCE and all other liquid,
gaseous, solid or other substances which will pollute any waters of [[this]] THE
State.

(c)    ["Treatment works" means any plant or other works, used for the purpose
of treating, stabilizing or holding wastes.]

"DISCHARGE" MEANS THE ADDITION, INTRODUCTION,
LEAKING, SPILLING, OR EMITTING ANY POLLUTANT TO STATE
WATERS OR THE PLACING OF ANY POLLUTANT IN A LOCATION
WHERE IT IS LIKELY TO POLLUTE.
