CHAPTER 733
(Senate Bill 1011)

AN ACT to add new Section 105A to Article 100 of the Annotated Code of
Maryland (1964 Replacement Volume and 1972 Supplement), title "'Work,
Labor and Employment," subtitle "Contracts for Public Works," to follow
immediately after Section 105 thereof, to prohibit the employment on Public
Works of persons classified as helpers and trainees, to provide that only
apprentices in a trade, craft or occupation for which an apprenticeship program
has been approved by the Apprenticeship and Training Council of the
Department of Licensing and Regulation shall be employed on Public Works,
and to provide that each such apprentice shall be paid not less than the
percentages, as set forth in such approved apprenticeship program, of the
journeyman mechanic's prevailing hourly rate of wages as determined by the
Commissioner of Labor and Industry for such journeyman mechanic in the
trade, craft or occupation in which the apprentice is employed on a Public
Works.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 105A be and it is hereby added to Article 100 of
the Annotated Code of Maryland (1964 Replacement Volume and 1972
Supplement), title "Work, Labor and Employment," subtitle "Contracts for Public
Works," to follow immediately after Section 105 thereof, and to read as follows:

105A.

NO PERSON CLASSIFIED AS A HELPER OR TRAINEE SHALL BE
EMPLOYED ON PUBLIC WORKS. ONLY APPRENTICES IN A TRADE,
CRAFT OR OCCUPATION FOR WHICH AN APPRENTICESHIP
PROGRAM HAS BEEN APPROVED BY THE APPRENTICESHIP AND
TRAINING COUNCIL OF THE DEPARTMENT OF LICENSING AND
REGULATION SHALL BE EMPLOYED ON PUBLIC WORKS. EACH
APPRENTICE EMPLOYED ON A PUBLIC WORKS SHALL BE PAID NOT
LESS THAN THE PERCENTAGES, AS SET FORTH IN SUCH APPROVED
APPRENTICESHIP PROGRAM, OF THE JOURNEYMAN MECHANIC'S
PREVAILING HOURLY RATE OF WAGES AS DETERMINED BY THE
COMMISSIONER OF LABOR AND INDUSTRY FOR SUCH
JOURNEYMAN MECHANIC IN THE TRADE, CRAFT OR OCCUPATION
IN WHICH THE APPRENTICE IS EMPLOYED ON THE PUBLIC WORKS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

Maryland (1972 Supplement), title "Revenue and Taxes," subtitle "What Shall
Be Taxed and Where," to follow immediately after Section 9(n) thereof,
