(3) PRESSURE VESSELS CONTAINING ONLY WATER UNDER
PRESSURE FOR DOMESTIC SUPPLY PURPOSES, INCLUDING THOSE
CONTAINING AIR, THE COMPRESSION OF WHICH SERVES ONLY AS
A CUSHION OR AIRLIFT PUMPING SYSTEM, WHEN LOCATED IN
PRIVATE RESIDENCES OR IN APARTMENT HOUSES OF LESS THAN
SIX (6) FAMILY UNITS.

173.

(a)  The present State boiler inspectors shall be retained in office by reason of
their having passed the competitive State of Maryland boiler inspector's
examination given by the State Commissioner of Personnel or his successor. At
any time hereafter when the office of chief boiler inspector or deputy boiler
inspector shall become vacant, the Commissioner of Personnel or his successor
shall, as soon as practicable, conduct a competitive examination in accordance with
State Merit System Law, the examination to be the same or equivalent to the
examination given by the Board of Boiler Rules for special inspectors in § 174 of
this subtitle. The Commissioner of Labor and Industry with the approval of the
Secretary of Licensing and Regulation shall appoint from the successful candidates
a chief boiler inspector or a deputy boiler inspector, as the case may be.

(b)  The chief boiler inspector, if authorized by the Commissioner of Labor and
Industry, is hereby charged, directed and empowered:

(1)   To take action necessary for the enforcement of the laws of the State
governing the use of boilers AND PRESSURE VESSELS to which this subtitle
applies and of the rules and regulations of the Board;

(2)  To keep a complete record of the type, dimensions, maximum allowable
pressure, age, location and date of the last recorded inspection of all boilers AND
PRESSURE VESSELS to which this subtitle applies;

(3)   To issue, or to suspend, or revoke for cause, inspection certificates as
provided for in § 177 of this subtitle;

(4)  To cause the prosecution of all violators of this subtitle.

(c)  Deputy boiler inspectors shall be responsible to the chief inspector and shall
perform such duties as the chief inspector may direct from time to time.

174.

(a) Upon the request of any company licensed to insure and insuring boilers
AND PRESSURE VESSELS in this State, the Commissioner of Labor and
Industry shall issue to any inspectors of said company commissions as special
inspectors, provided that each such inspector before receiving his commission shall
satisfactorily pass the examination provided for in subsection (b) of this section, or,
in lieu of such examination, shall hold a commission or a certificate of competency
as an inspector of boilers AND PRESSURE VESSELS for a state that has a
standard of examination substantially equal to that of the State of Maryland or a
commission as an inspector of boilers AND PRESSURE VESSELS issued by the
National Board of Boiler and Pressure Vessel Inspectors. No special inspectors
shall receive salary from, nor shall any of their expenses be paid by, the State, and
the continuance of a special inspector's commission shall be conditioned upon his
continuing in the employ of the boiler insurance company duly authorized as
aforesaid and upon his maintenance of the standards imposed by this subtitle.
When such special inspectors inspect boilers AND PRESSURE VESSELS insured
by their respective companies, such inspection shall exempt the owners and users of
such boilers AND PRESSURE VESSELS from the payment to the State of the
