170.
The Board shall formulate definitions, rules and regulations for the safe
construction, use, installation, maintenance, repair and inspection of boilers AND
PRESSURE VESSELS in this State. The rules and regulations so formulated
shall conform as nearly as possible to the Boiler and Pressure Vessel Code of the
American Society of Mechanical Engineers and to the Inspection Code of the
National Board of Boiler and Pressure Vessel Inspectors as amended and
interpreted from time to time. Rules and regulations formulated by the Board
[shall 1 MAY be adopted and promulgated by the Commissioner of Labor and
Industry subject to the approval of the Secretary of Licensing and Regulation in
the same manner as rules and regulations of the Occupational Health and Safety
Advisory Board established by § 31 (a) of Article 89 of the Annotated Code of
Maryland (1964 Replacement Volume, 1968 Supplement).

(a) No new boiler OR PRESSURE VESSEL which does not conform to the
rules and regulations formulated by the Board governing new construction and
installation shall be installed and operated in this State at any time after twelve
(12) months from the date upon which the first rules and regulations under this
subtitle pertaining to new construction and installation shall have become effective,
unless the boiler OR PRESSURE VESSEL is of special design or construction
and is not inconsistent with the spirit and safety objectives of such rules and
regulations, in which case a special installation and operating permit may, at its
discretion, be granted by the Board.
(b) With regard to existing boiler AND PRESSURE VESSEL installations,
(1) The maximum allowable pressure of a boiler OR PRESSURE VESSEL
carrying the ASME Code symbol shall be determined by the applicable sections of
the Code under which it was constructed and stamped;
(2) The maximum allowable pressure of a boiler OR PRESSURE VESSEL
which does not carry the ASME Code symbol shall be computed in accordance
with the Inspection Code of the National Board of Boiler and Pressure Vessel
Inspectors; and
(3) This subtitle shall not be construed as in any way preventing the use, sale or
reinstallation of a boiler OR PRESSURE VESSEL referred to in this section,
provided it has been made to conform to the rules and regulations of the Board
governing existing installations and provided further it has been found upon
inspection not to be in an unsafe condition.
[172.
This subtitle shall not apply to the following:
(a) Boilers under federal control or regulation;
(b) Boilers located on farms and used exclusively for agricultural purposes;
(c) Steam or vapor boilers carrying a pressure of not more than fifteen (15)
psig, which are located in private residences or in apartment houses of less than six
(6) family units;
(d) Hot water boilers operated at pressures not exceeding 160 psig, or
temperatures not exceeding 250 degrees F., Which are located in private residences
or in apartment houses of less than six (6) family units.]
