Ch. 682                             MARVIN MANDEL, Governor                                 1427

(J) ANY PERSON, FIRM OR CORPORATION VIOLATING THE
PROVISIONS OF THIS SECTION IS GUILTY OF A MISDEMEANOR
AND, UPON CONVICTION, IS SUBJECT TO THE FOLLOWING
PENALTIES. A CONVICTION UNDER THIS SECTION IS TO BE
PUNISHED BY A FINE NOT TO EXCEED ONE THOUSAND DOLLARS
($1,000.00), FOR EACH EMPLOYEE CAUSED, DIRECTED, PERMITTED
OR AUTHORIZED TO WORK IN VIOLATION OF THIS SECTION.
NOTHING CONTAINED HEREIN SHALL BE CONSTRUED TO PERMIT
ANY FINE UPON ANY EMPLOYEE OR AGENT WHO HAS BEEN
CAUSED OR DIRECTED BY HIS EMPLOYER TO VIOLATE THE
PROVISIONS OF THIS SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That if any part or parts
of this Act are declared by a court of competent jurisdiction to be invalid or
unconstitutional as applied to any subsection, such invalidity or unconstitutionality
shall not be construed to extend to any other subsection, it being the legislative
intent that the provisions of this Act are severable.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 682

(Senate Bill 414)

AN ACT to repeal and re-enact, with amendments, Sections 13-101 and 13-103 of
Article 66-1/2 of the Annotated Code of Maryland (1970 Replacement
Volume), title "Vehicle Laws," subtitle "13. Inspection of Used Vehicles and
Warnings for Defective Equipment," to modify the definition of "motor
vehicle" to include I [Class E trucks, Class F tractors, and Class G trailers]]
any class of motor vehicle, trailer or semi- trailer for the purpose of issuing
equipment repair orders by an officer of a Police Department; to define
"Administration", to require certain additional equipment on motor vehicles in
order to meet standards as jointly fixed and determined by the Motor Vehicle
[[Administation]] Administration and the Automotive Safety Enforcement
Division of the Maryland State Police; and to correct certain obsolete language.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 13-101 and 13-103 of Article 66-1/2 of the
Annotated Code of Maryland (1970 Replacement Volume), title "Vehicle Laws,"
subtitle "13. Inspection of Used Vehicles and Warnings for Defective Equipment,"
be and they are hereby repealed and re-enacted, with amendments, to read as
follows:

13-101.
As used in this subtitle, the following words have the meaning indicated:

(1) "Registered dealer" means a dealer who is licensed under Subtitle 5 to deal
in new or used cars.
