CHAPTER 659
(Seriate Bill 174)

AN ACT to add new Section 23 to Article 51 of the Annotated Code of Maryland
(1972 Replacement Volume), title "Juries,"' to follow immediately after Section
22 thereof, thereby providing for the continuation of a grand jury [[and for the
impaneling of an additional grand jury]] under certain circumstances.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 23 be and it is hereby added to Article 51 of the
Annotated Code of Maryland (1972 Replacement Volume), title "Juries," to
follow immediately after Section 22 thereof, and to read as follows:

23.

[[(A) WHEN THE GRAND JURY FOR ANY REGULAR TERM OF A
CIRCUIT COURT OR OF THE CRIMINAL COURT OF BALTIMORE HAS
BEGUN AN INVESTIGATION OR INQUIRY PRIOR TO THE END OF
ITS TERM AND THE ATTORNEY GENERAL ACTING PURSUANT TO
AN INVESTIGATION ORDERED BY THE GOVERNOR OR THE
GENERAL ASSEMBLY OR PURSUANT TO A REQUEST BY THE
STATE'S ATTORNEY, OR THE STATE'S ATTORNEY DEEMS IT
NECESSARY OR DESIRABLE THAT THE INVESTIGATION OR
INQUIRY BE CONTINUED BY THE SAID GRAND JURY INTO THE
NEXT SUCCEEDING TERM, EITHER THE ATTORNEY GENERAL OR]]
OR THE STATE'S ATTORNEY MAY PETITION A JUDGE OF THE
CIRCUIT COURT OR OF THE CRIMINAL COURT OF BALTIMORE
HAVING JURISDICTION FOR AN ORDER AND SAID JUDGE MAY
ISSUE AN ORDER DIRECTING THE GRAND JURY TO BE SO
CONTINUED AND SPECIFYING THE PARTICULAR INVESTIGATION
OR INQUIRY FOR WHICH IT IS TO BE CONTINUED. WHEN SO
ORDERED A GRAND JURY SHALL POSSESS ALL THE POWERS IT
HAD WHEN ORIGINALLY APPOINTED, EXCEPT THAT IT SHALL BE
LIMITED TO THE INVESTIGATION OR INQUIRY SPECIFIED IN THE
COURT ORDER. THE GRAND JURY SHALL CONTINUE ITS
INVESTIGATION UNTIL THE SAME HAS BEEN COMPLETED OR
UNTIL SOONER DISCHARGED BY ORDER OF THE JUDGE WHO
ORDERED THE TERM EXTENDED.

[[(B) WHENEVER THE ATTORNEY GENERAL ACTING PURSUANT
TO AN INVESTIGATION ORDERED BY THE GOVERNOR OR THE
GENERAL ASSEMBLY OR UPON REQUEST OF A STATE'S ATTORNEY,
OR A STATE'S ATTORNEY DEEMS IT NECESSARY OR DESIRABLE,
HE MAY PETITION A JUDGE OF THE CIRCUIT COURT OR CRIMINAL
COURT OF BALTIMORE FOR AN ORDER AND THE JUDGE MAY
ISSUE AN ORDER DIRECTING THAT AN ADDITIONAL GRAND JURY
OR JURIES BE SELECTED AND SWORN IN TO CARRY OUT THE
SPECIFIC PURPOSE OR PURPOSES STATED IN THE PETITION. WHEN
SO ORDERED AN ADDITIONAL GRAND JURY OR JURIES SHALL
CONTINUE IN EXISTENCE UNTIL IT IS DISSOLVED BY ORDER OF
THE JUDGE CREATING SAID GRAND JURY OR JURIES. DURING ITS
EXISTENCE, THE ADDITIONAL GRAND JURY OR JURIES SHALL
HAVE ALL THE POWERS OF A GRAND JURY WITH RESPECT TO THE
PURPOSE OR PURPOSES STATED IN THE COURT ORDER.]]
