21.

(b) The following shall constitute employees subject to the provisions of this act,
except as exempted under subsection (c) of this section:

(1)   Every person, including a [minor] PERSON UNDER EIGHTEEN
YEARS OF AGE, whether lawfully or unlawfully employed, in the service of an
employer under any contract of hire or apprenticeship, express or implied, and all
helpers and assistants of employees whether paid by the employer or employee, if
employed with the knowledge, actual or constructive, of the employer.

(2)  Every officer of the corporation rendering services for said corporation
for monetary remuneration.

(3)   Any employer, partner or sole proprietor electing coverage under the
provisions of Sec. 67(4) of this article.

(4)  Every person in the service of any political subdivision or agency thereof,
under any contract of hire, express or implied, and every official or officer thereof,
whether elected or appointed, while performing his official duties. Except as
provided in subsection 21(c)(6) of this act, every person who is a member of a
volunteer fire or rescue squad or police department shall be deemed for the
purpose of this act, to be in the employment of the political subdivision of the
State where the department is organized. Except as provided in subsection 21(c)(6)
of this act, every person who is a regularly enrolled volunteer member or trainee of
the civil defense corps of this State as established under the Maryland Civil
Defense Act shall be deemed, for the purposes of this act, to be in the employment
of the State.

(5)  Every person performing services for remuneration in the course of the
trade, business, profession or occupation of an employer at the time of the injury,
provided such person in relation to this service does not maintain a separate
business, does not hold himself out to and render service to the public and not
himself an employer subject to this act.

(6)  Subject to the provisions of this section, every person regularly selling or
distributing newspapers on the street or to customers at their homes or places of
business. For the purposes of this act, such person shall be deemed an employee of
any independent news agency for whom he shall sell newspapers, or of each
publisher who engages such persons to sell or distribute its newspapers.

(7)  Any person who is an apprentice, trainee, or retrainee, who is regularly
employed, while receiving training or instruction outside of regular working hours
so long as the training or instruction is related to his employment.

(8)  Farming and dairy farming, other than office work, and including, by way
of illustration and not by way of limitation, the operation of any machinery
connected with any phase of soil, crop or animal management, construction and
repairs of machinery and fixtures, and the handling of any crops or animals with
or without machinery.

For the purposes of this section, a farmer is defined as one who has three (3) or
more full-time employees or who has a yearly payroll for his full-time employees
of at least fifteen thousand dollars ($15,000) provided, however, that this section
shall not apply to seasonal or migratory farm laborers who do not operate
machinery or equipment.
