45A.
(A) THE STATE HIGHWAY ADMINISTRATION IS EMPOWERED,
AFTER CONCURRENCE WITH THE LOCAL JURISDICTION, TO
REQUIRE DEVELOPERS OF INDUSTRIAL, COMMERCIAL OR
APARTMENT AREAS, ADJOINING ROADS MAINTAINED BY THE
STATE HIGHWAY ADMINISTRATION, TO CONSTRUCT SIDEWALKS
PARALLEL TO THE ROADS IN ACCORDANCE WITH SPECIFIED
CONDITIONS IN ENTRANCE PERMITS. SIDEWALK CONSTRUCTION
SHALL BE IN ACCORDANCE WITH STATE HIGHWAY
ADMINISTRATION OR LOCAL STANDARDS AS APPROPRIATE.
(B) SIDEWALKS SHALL NOT BE REQUIRED UNDER SUBSECTION
(A) OF THIS SECTION, IF THE STATE HIGHWAY ADMINISTRATION
DETERMINES THAT:
(1) THE ESTABLISHMENT OF SIDEWALKS WOULD BE
CONTRARY TO PUBLIC SAFETY;
(2) THE COST OF ESTABLISHING THE SIDEWALKS WOULD BE
EXCESSIVELY DISPROPORTIONATE TO THE NEED OR THE
PROBABLE USE THEREOF; OR
(3) THE SPARSITY OF POPULATION, THE EXISTENCE OF OTHER
AVAILABLE WAYS OR OTHER FACTORS DEMONSTRATE AN
ABSENCE OF ANY NEED FOR THE SIDEWALKS.
(C) WHEN SIDEWALKS ARE CONSTRUCTED, THEY SHALL
THEREAFTER BE MAINTAINED AND REPAIRED BY THE POLITICAL
SUBDIVISION IN WHICH THEY ARE LOCATED.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

(House Bill 985)
AN ACT to add new Section 200A to Article 43 of the Annotated Code of
Maryland (1971 Replacement Volume), title "Health," subtitle "Food
Products," to follow immediately after Section 200 thereof, to exempt certain
small residential group homes for juveniles from certain institutional health
regulations; to generally relate to juvenile group homes and the health
regulations; and to re-letter and re-number as appropriate.
WHEREAS, The General Assembly wishes to re-affirm its concern for the
well-being of the youth of Maryland. For various reasons, on occasion some of
these youth have been unable to remain at home for a period of time, and have
had to be placed in group homes and elsewhere. While some facilities are operated
by the State and local governments, from time to time existing facilities become
over-crowded, and children need emergency shelter care. It is desirable to provide
maximum encouragement to private organizations willing to fill the need of
children for small group residences having a home-like, rather than an
