re-enact, with amendments, Section 357C(e) of the said Article, subtitle, and
subheading of the Code, to change definitions in the Open Spaces Program in
order to define the items of expenses payable as part of the total costs of an
open spaces project and to include operation and maintenance costs as allowable
expenses for a specified period of time in Baltimore City open spaces projects.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 357C(h) be and it is hereby added to Article 66C
of the Annotated Code of Maryland ([[1970 Replacement Volume and]] 1972
Supplement), title "Natural Resources," subtitle "Forests and Parks," subheading
"Program Open Space," to follow immediately after Section 357C(g) thereof
[ [and ]] and that Section 357C(e) of the said Article, subtitle, and subheading of
the Code, be and it is hereby repealed and re-enacted, with amendments, and all to
read as follows:

357C.

(e) "Local projects" means acquisition and/or development of projects
sponsored by the local governing bodies or agencies thereof, AND__IN_ THE CASE
OF BALTIMORE CITY IT ALSO MEANS OPERATION AND
MAINTENANCE OF PROJECTS AS PROVIDED IN SUBSECTION (H) OF
THIS SECTION.

(H) "TOTAL PROJECT COST" MEANS ALL DIRECT COSTS
ATTRIBUTABLE TO A PARTICULAR PROJECT, INCLUDING, BUT NOT
LIMITED TO, [[EMPLOYEE COMPENSATION FOR TIME AND EFFORT
DEVOTED TO THE PROJECT,]] COSTS OF MATERIALS, COSTS OF
EQUIPMENT AND OTHER CAPITAL EXPENDITURES, OR THE
ACQUISITION OF LAND, AS WELL AS ALL INCIDENTAL COSTS
RELATING TO ACQUISITION OF INTERESTS IN REAL PROPERTY,
INCLUDING, BUT NOT LIMITED TO, THE COSTS OF SURVEYS,
APPRAISALS, TITLE SEARCH, AND LEGAL FEES, HAND
RELOCATION COSTS REQUIRED UNDER THE UNIFORM
RELOCATION AND REAL PROPERTIES ASSISTANCE ACT. ]] THE
TOTAL PROJECT COSTS WHICH MAY. BE REIMBURSED FOR
INCIDENTAL COSTS RELATED TO ACQUISITION OF REAL
PROPERTY SHALL BE LIMITED TO THE FEE SCHEDULES APPROVED
BY THE BOARD OF PUBLIC WORKS FOR SUCH INCIDENTAL COSTS.
FOR BALTIMORE CITY, FOR THE TWO-YEAR PERIOD BEGINNING
JULY 1, 1973 AND ENDING JUNE 30, 1975, "TOTAL PROTECT COST"
ALSO MEANS ALL COSTS OF OPERATION AND MAINTENANCE OF
PROJECTS FINANCED UNDER PROGRAM OPEN SPACE, PROVIDED,
HOWEVER, THAT THE AMOUNT OF PROGRAM OPEN SPACE FUNDS
EXPENDED FOR OPERATION AND MAINTENANCE SHALL NOT
EXCEED THAT PROPORTION OF THE ALLOCATION TO BALTIMORE
CITY WHICH IS DERIVED FROM CURRENT REVENUES, AS
DISTINGUISHED FROM PROCEEDS OF BOND ISSUES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
