may at the same time condemn the interest of any tenant, lessee or other person
having an interest in said property. At any time after ten days after the return and
recordation of the verdict and award in [said] THE proceedings, the [said]
authorities may enter upon and take possession of said property so condemned,
upon first paying to the clerk of the court the amount of [said] THE award, and
all costs and taxes to date, notwithstanding any appeal or further proceeding upon
the part of the defendant. At the time of said payment, however, [it] ANY
AUTHORITY shall give its corporate undertaking to abide by and fulfill any
judgment on [such] THE appeal or further proceedings.

(b) (8) To acquire by gift, purchase or by the exercise of the right of eminent
domain, in the manner prescribed by [Article 33A of the Annotated] TITLE 12
OF ARTICLE 21 OF THIS Code [of Maryland (1957 Edition), as from time to
time amended), lands or rights in land or water rights in connection therewith;
provided, however, that no property or any interest or estate therein owned by any
county, city, town or other political subdivision of the State shall be acquired by
the exercise of the power of eminent domain without the consent of the governing
body of [such] THE county, city, town or political subdivision, nor any existing
privately owned and operated water, sewerage or solid waste acceptance facility
system without the consent of the owners and operators thereof except a privately
owned and operated system or facility may be condemned without consent if it is
required as an integral part of a sanitary district created under this subtitle or if
the system is not being maintained and operated in compliance with applicable
laws and regulations of the State. At any time after ten days after the return and
recordation of the verdict or award in any condemnation proceedings, the district
may enter and take possession of the property so condemned, upon first paying to
the clerk of the court the amount of [said] THE award and all costs taxed to that
date, notwithstanding any appeal or further proceedings upon the part of the
defendant. At the time of [said] THE payment, however, the district shall give its
corporate undertaking to abide by and fulfill any judgment in [such] THE appeal
or further proceedings.

After the passage of this subtitle, whenever the county or the property owners
or residents of any locality in the area served by a district shall desire a water,
sewerage or solid waste disposal system or part thereof, including a solid waste
acceptance facility, to be constructed or provided in that county or locality, and
the commission shall decide that it is inexpedient or impracticable at that time,
owing to the remoteness from its general system or other causes, to build or
provide [such] THE system or facility, [such] THE county or persons may build
and operate [said] THE system or facility at its or their own expense, but it shall
be constructed under plans and specifications approved by the commission, and its
maintenance and operation shall be under the general control of the commission;
and no [such] system or facility or part thereof, or no water main, sewer, water
purification or sewage treatment plant, or no connection with any of them, shall be
constructed or installed except as in this section provided, and any violation of this
provision [shall be] IS a misdemeanor punishable under § 669 of this subtitle. All
construction and operating records, including cost records, shall be filed with the
commission, which [shall be empowered] MAY at any time [to] take over [said]
THE system or facility or part thereof, or [said] THE water main, sewer, water or
sewage treatment plant or solid waste acceptance facility or connect on with any of
them in the same manner as provided under § 665 for systems existing at the time
of the passage of this subtitle. The commission [shall be empowered to] MAY
extend its water, sewerage or solid waste disposal systems into any area outside of
any sanitary district contiguous thereto and not included in the territory under the
