1000 LAWS OF MARYLAND Ch. 460
person shall receive prior service credit for service rendered prior to the date he
was first eligible to become a member and membership credit for service rendered
subsequent thereto, provided that he shall pay to the retirement system, by a single
payment prior to his retirement or death, the contributions which he would have
made had he in fact belonged to the system during the period he was eligible,
together with regular interest thereon.
(5) A teacher whose membership in the retirement system was contingent upon
his own election who did not elect to become a member and who, as of June 1,
1952, has been continuously employed as a teacher since the time he or she was
first eligible for membership in said system, shall have a right of election to join
said system under the provisions of this subsection. Such right of election shall
apply and be effective only for the period beginning on the effective date of this
subsection and continuing thereafter for a period of one year. Any such teacher
making an election within that period shall receive all membership and prior
service benefits as provided for other members of the system and in accordance
with §§ 190, 192, 194 and 195 of this article. Before being admitted to such
membership, any such person shall pay to the retirement system the full amount of
what would have been his accumulated contributions therein had he in effect
belonged to the system from the time he was first eligible to become a member
thereof to the time of making application for such membership, together with
regular interest thereon.
(5a) Any person who has served as a teacher in any private school in Maryland
which school has by reason of accepting and educating without charge, children
eligible for but unable to attend public school by reason of the absence of public
school facilities in the community, and who is presently serving as a public school
teacher in Maryland shall be given membership service for the period spent in such
private school prior to the year 1940. To be eligible to receive credit for this
membership service, the person shall pay to the retirement system the full amount
of what would have been his accumulated contributions therein had he in fact been
a member of the retirement system during the period spent in the private school.
(6) The board of trustees may, in its discretion, deny the right to become
members to any class of teachers whose compensation is only partly paid by the
State or who are serving on a temporary or other than per annum basis, and it
may also in its discretion make optional with members in any such class their
individual entrance into membership.
(7) Should any member in any period of six consecutive years after last
becoming a member be absent from service more than five years, or should he
withdraw his accumulated contributions, or should he become a beneficiary or die,
he shall thereupon cease to be a member. However, any such person who has
withdrawn his accumulated contributions (other than one who has become a
beneficiary or died) may subsequently redeposit in the retirement system the
amount of accumulated contributions previously withdrawn, with interest to the
date of redeposit, and regain previous service credit with the condition, however,
that he may not retire within three years after the date of reentry in the retirement
system.
Any member who had terminated membership in the Employees' Retirement
System or the State Police Retirement System may and upon deposit into the
Teachers' Retirement System of the accumulated contributions previously
withdrawn from the Employees' System or the State Police System, with interest
to date of deposit, receive credit in the Teachers' System for the service that had
previously been terminated with the condition, however, that he may not retire
within three years after the date of entry in the Teachers' Retirement System.
