of the facility, complete records of each person. Such records shall
contain copies of all data required by this article, and such additional
information as may be required by the Administration. Such records
shall be open for inspection by persons designated by the Director and
in accordance with the provisions of the Privileged Communications
Act, Article 35, Section 13A, of the Code, but shall be closed to all
other persons.
Facilities
18. Powers and Duties of Superintendents.
(a) No county or municipal hospital shall for purposes of this
article, be considered a public facility.
(b) The superintendent of each public facility shall have general
supervisory powers and duties with respect to the facility that he
administers. He shall have such additional powers and duties as may
be delegated to him by the Director.
(c) The superintendent of each public facility shall appoint such
personnel as may be needed and are provided for in the budget.
The appointments shall be made in accordance with the provisions of
the Merit System Law, and subject to the approval of the Director.
(d) The superintendent of each public facility shall, at intervals
as directed by the Director, make such reports in such details as may
be required by the Director.
(e) The superintendent of each facility, public or private, in
which mentally retarded persons are served, shall furnish to the
Director or his authorized representatives, on request:
(1) Any information in his possession relative to such mentally
retarded persons;
(2) Free access to all records pertaining to such mentally re-
tarded persons, their care or treatment;
(3) Free access to any such mentally retarded person; and
(4) Free access to any portion of the facility used for or in con-
junction with the care, maintenance, sustenance or treatment of such
mentally retarded persons.
(f) The superintendent of any facility licensed by or within the
jurisdiction of the Administration may select any employee to act as
a law enforcement officer, and upon being commissioned by the
Governor (in the manner provided for employees of other organi-
zations in accordance with Article 23, subtitle: "Police"), such em-
ployees may return any escaped mentally retarded person to the
facility from which he escaped, and may be utilized to protect persons
or property at the facility.
19. Public Facilities:
(a) The following existing facilities shall be maintained as pub-
lic facilities under the general jurisdiction of the Administration:
