tide and for the operation and administration of the Mental Retarda-
tion Administration as are needed.
7. Director
The chief executive officer of the Administration shall be the Di-
rector. The Director shall be a person who has demonstrated compe-
tence in the field of mental retardation and its administration. He
shall be appointed by the Secretary and shall serve at the pleasure
of the Secretary. The Director shall receive such salary as may be
provided in the budget,. All powers, duties and responsibilities vested
in the Director shall be exercised or performed by him or his sub-
ordinates subject to the authority of the Secretary; and the Secre-
tary may, in his discretion, exercise or perform any power, duty or
responsibility which the Director is authorized to exercise or per-
form.
8. Powers and Duties of the Director
The Director shall have the following powers and duties:
(a) He shall organize and administer the Administration in such
manner as will best enable it to discharge the duties assigned to it by
law and by the Secretary.
(b) He shall appoint, subject to the approval of the Secretary,
such deputy and assistant directors AND SUPERINTENDENTS as
may be provided for in the budget.
(c) He shall be responsible for supervision, direction, and con-
trol of the operation of each public facility within the jurisdiction of
the Administration.
(d) He shall provide or encourage, by consultation, cooperation,
contract, or direct operation, all necessary services to facilitate the
early detection, accurate evaluation, proper referral, adequate pro-
tection, and optimal development of mentally retarded persons in
need of services, whether in a residential program or a program pro-
viding less than 24 hour care.
(e) He shall negotiate with public or private agencies and indi-
viduals within or without the State for the provision of any service
for which the Administration has responsibility, but which may be
more effectively provided for by purchase of service than direct ad-
ministration.
(f) He shall establish criteria for admission to and retention
in public facilities within the jurisdiction of the Administration.
(g) He shall promulgate regulations and standards for licensing
of private and public facilities for the mentally retarded.
(h) He shall promote effective planning for and citizen support of
programs related to the mentally retarded.
(i) He shall insure that individual rights and liberties of the
mentally retarded are protected,. If he finds any person being held by
a public or private facility in a manner contrary to law or the pro-
visions of this article, he shall institute appropriate proceedings to
obtain the release of that person.
