financial assistance from the Board, unless it has met all of the
qualifications and requirements as set forth in such rules and regu-
lations. The decision of the Board, after approval by the Secretary
of Agriculture,
shall be final with respect to all questions relating
to whether any agricultural fair, exhibit or activity shall be entitled
to financial assistance under the provisions of this section.

DRAINAGE

64. Establishment of Department of Drainage under Drainage Engi-
neer; powers and duties of Drainage Engineer.

[There is hereby established a State Department of Drainage under
the State Board of Agriculture, the said department to be adminis-
tered by the professor of agricultural engineering of the University
of Maryland who, for the purpose of this section, shall be desig-
nated as the State Drainage Engineer.]

It shall be the duty of the [State Drainage Engineer] the Secre-
tary of Agriculture
to promote and encourage the drainage of
agricultural lands in the State, to correlate the activities of the
local drainage organizations in the State and to cooperate with
State and federal agencies in the interest of a permanent program
of improved drainage. [The State Drainage Engineer is hereby au-
thorized to use such technical and clerical assistance as may be under
the control of the State Board of Agriculture with the approval
of said Board.] The [State Department of Drainage] Secretary
shall have the powers necessary to accomplish the purposes herein
set forth.

72. Definitions.

For the purpose of this subheading, unless otherwise required by
the context:

(a) The term ["Board"] "Secretary" means the [State Board]
Secretary of Agriculture.

[(b) The term "Department" means the State Department of
Markets.]

[(c)](b) The term "person" means any person, firm, corporation
or association.

[(d)](c) The term "fruit" and "vegetable" means any fruit or
vegetable, both singular and plural, sold, offered or exposed for sale,
packed for sale, transported for sale, shipped or presented for in-
trastate or interstate shipment, but not any fruit or vegetable
which has been canned, dried, pickled or frozen.

[(e)](d) The terms "sell" and "sold" mean sale, offer or expose
for sale, pack for sale, transport for sale, ship, or present for intra-
state or interstate shipment, in the present, future or past tenses.

73. Standards, grades, etc.—In general.

The [State Board of Agriculture through the Maryland State
Department of Markets] Secretary and [its] his duly authorized
agents may, after investigation and public hearing: (1) Prescribe
from time to time, official standards or grades for any fruit or vege-
table, (2) promulgate from time to time rules and regulations govern-
