(1964 Replacement Volume and 1971 Supplement), title "Weights
and Measures," subtitles "Standard Weights and Measures" and
"State Apple Commission"; creating the Department of Agricul-
ture as a principal department of the State Government and pro-
viding for its organization, structure, staffing, powers and duties;
providing for the Secretary of Agriculture and for his powers, du-
ties, functions, and responsibilities; assigning to the Department
of Agriculture the Inspector of Tobacco, the Tobacco Authority
of the State of Maryland, the Maryland State Fair Board, the Mary-
land State Apple Commission, the State Superintendent of Weights
and Measures, the State Chemist, the State Veterinarian AND THE
STATE BOARD OF VETERINARY MEDICAL EXAMINERS,
the Wholesome Poultry Advisory Council of Maryland, the Whole-
some Meat Advisory Council of Maryland, the State Soil Conserva-
tion Committee, the Board of Review of the Department of Agricul-
ture, and the Maryland Agricultural Commission, and such other
agencies as may hereafter be assigned to the said Department; RE-
MOVING THE SECRETARY OF HEALTH AND MENTAL HY-
GIENE FROM CERTAIN DUTIES RELATING TO THE STATE
BOARD OF VETERINARY MEDICAL EXAMINERS; abolish-
ing the State Board of Agriculture, the State Horticultural Depart-
ment, the State Entomologist, the State Pathologist, the State
Horticulturist, tree and fruit inspectors, the Department of Drain-
age, the State Drainage Engineer, and the Maryland State Depart-
ment of Markets, and Transferring to the Department of Agricul-
ture the functions performed by said agencies; continuing in effect
rules and regulations of agencies transferred to the Department or
abolished until changed; changing references to abolished agen-
cies; providing for counsel to the Department; creating the Board
of Review of the Department of Agriculture and providing for its
composition, duties, powers, procedures, and removal of members;
eliminating the requirement that three members of the Board of
Regents of the University of Maryland be appointed upon nomina-
tion by the Maryland Agricultural Commission; changing the terms
of present members of the Board of Regents appointed upon nomi-
nation by said Commission; providing that the Secretary of Agri-
culture be an ex officio member of the Board of Regents; providing
for appointment and removal of the Inspector of Tobacco by the
Secretary of Agriculture and giving the Secretary certain approval
power over the duties and powers of the said Inspector; giving the
Secretary certain powers with respect to the composition, duties
and powers of agencies assigned to the Department of Agricul-
ture; substituting the District Court for justices of the peace with
respect to the enforcement of laws dealing with agriculture; chang-
ing the composition of the Maryland Agricultural Commission; pro-
viding for the transfer of property, credits, appropriations, liabili-
ties and employees to the Department of Agriculture, and pre-
serving the merit system status of such employees; and dealing gen-
erally with agriculture and the Department and Secretary of
Agriculture.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 430 through 437 be and they are hereby
added to Article 41 of the Annotated Code of Maryland (1971 Replace-
ment Volume and 1971 Supplement), title "Governor—Executive and
Administrative Departments," to be under the new subtitle "41. The
