CHAPTER 185
(Senate Bill 21)
AN ACT to repeal and re-enact, with amendments, Section 151 (d)
of Article 56 of the Annotated Code of Maryland (1971 Supple-
ment) , title "Licenses," subtitle "Motor Vehicle Fuel Tax," to pro-
vide for the portions of the motor vehicle FUEL tax to be allocated
to the Waterways Improvement Fund and the Fisheries Research
and Development Fund.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 151(d) of Article 56 of the Annotated Code of Maryland
(1971 Supplement), title "Licenses," subtitle "Motor Vehicle Fuel
Tax," be and it is hereby repealed and re-enacted, with amendments,
to read as follows:
151.
(d) Of the net motor vehicle fuel tax revenues available for dis-
tribution under this section, as determined by the Gasoline Tax Divi-
sion [four hundred thousand dollars ($400,000)] three-eights of
one percent shall be allocated to the use of the Waterways Improve-
ment Fund and three-eighths of one percent shall be allocated to the
Fisheries Research and Development Fund. [For the 1972 and 1973
fiscal years only, the entire amount of this sum shall be disbursed to
the Fish and Wildlife Administration, and for all succeeding fiscal
years this sum shall be disbursed to the fund.]
From and after July 1, 1968, no further refund of taxes on motor
vehicle fuel, as defined in this subtitle shall be allowed for watercraft
usage, except in the case of watercraft used and devoted to commercial
purposes, the refunds of which shall continue to be paid from the
gross revenues of the gasoline tax.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.

CHAPTER 186

AN ACT to repeal and re-enact, with amendments, Section 1(3)
of Article 73B of the Annotated Code of Maryland (1971 Supple-
ment), title "Pensions," subtitle "In General," amending the Em-
ployees' Retirement System Law to clarify the exclusion of mem-
bership in the Retirement System as to Judges of Circuit Courts,
Supreme Bench of Baltimore City, Court of Appeals of Maryland,
Court of Special Appeals, and District Courts AND TO ADD NEW
SECTION 9(10) TO THE SAID ARTICLE AND SUBTITLE
OF THE CODE (1970 REPLACEMENT VOLUME), TO FOL-
LOW IMMEDIATELY AFTER SECTION 9(9) THEREOF,
TO CHANGE THE MEMBERSHIP OF THE EMPLOYEES'
