and shall pay upon conviction before a [justice of the peace or]
court of competent jurisdiction, a fine equal to the damages as-
certained as suffered by the owner or occupier of said fishery, and in
addition thereto, the cost of prosecution[; the amount of fine so
imposed shall be paid to the owner or occupier of the fishery, and the
vessel, float or boat shall be held as security for the payment of the
fine].

§ 254. Penalty—Generally.

Any person found guilty of violating any of the provisions of the
preceding sections of this subtitle, with the exception of § 246, un-
less the penalty is provided for in the section, shall be deemed guilty
of a misdemeanor and upon conviction thereof before a [justice
of the peace qualified to try same or] court, shall be fined the sum
of not less than $25 nor more than $100[, and shall stand committed
to the county jail or the Baltimore City jail until such fine and costs
are paid; and a]. All fines and costs shall be paid in accordance with
Article 38.,
§ 4. All boats, nets, seines or other equipment used for
the purpose of violating any of the above sections shall be declared
forfeited, and the fines and forfeitures imposed shall be disposed of as
provided for in § 242.

§ 305. In general.

Any person found guilty of violating any section of this subhead-
ing, unless the penalty is provided for in the section, shall be guilty
of a misdemeanor and upon conviction thereof before a [justice of
the peace qualified to try same, or by any] court [upon appeal,]
shall be fined the sum of not less than $25.00 nor more than $100.00
[and shall stand committed to the county jail or the Baltimore City
jail until such fine and costs are paid, and a]. All fines and [for-
feitures] costs shall be paid in accordance with Article 38, § 4, and
disposed of as provided for in § 242.

§ 308. Beam trawl, trammel nets and troll nets.

The use of any beam trawl, trammel net, troll net or any similar
device is absolutely prohibited in the waters of the Potomac
River or any of its tributaries. Any person, firm or corporation vio-
lating the provisions of this section shall on conviction thereof before
any [justice of the peace of any county of this State] court
most accessible, forfeit said net or nets, or device, together with
all boats, vessels and tackle used in the violation of this section and
be fined a sum of not less than fifty dollars and not more than one
hundred dollars, or to be subject to both fine and forfeiture, in the
discretion of the [justice of the peace trying the case] court. Pro-
vided, however, that nothing in this section shall be construed, in any
manner, to prohibit the catching of fish through the method of seine
hauling and pound net or gill net fishing as heretofore permitted, by
license or otherwise, under the laws of the State of Maryland.

§ 309. Jurisdiction and rights of officers of Maryland.

All offenses committed against the provisions of §§ 306, 307
and 309-311 may be punished by any [of the magistrates or]
court[s] of the State of Maryland having criminal jurisdiction.
