Reference, the police commissioner of Baltimore City, and the State
Tax Commission, one copy each; and to the librarian of the library
company of the Baltimore Bar, such copies of the published opinions,
laws [laws], journals and documents of the State of Maryland of
which he may now have duplicates and of which he may have du-
plicates from time to time as new volumes are published, as can be
spared from the State Library, not exceeding in each case two copies
of such volumes. The remainder of said published opinions shall be
deposited in the State Library and shall be retained in the State
Library or distributed under the direction of the library committee
or may be used by the State Library for exchange purposes.

Section 42. And be it further enacted, That Sections 57, 62, 74,
104, 112, 114, 201, 262, 263, 413, 424, and 669 of Article 43, Annotated
Code of Maryland (1971 Replacement Volume), title "Health," sub-
titles, respectively, "Infectious Diseases—In General," "Vaccine
Virus," "Nuisances," "Food Products," "Commissioners of Phar-
macy," "Water, Ice and Sewerage," and "Sanitary Districts," be and
they are hereby repealed and re-enacted, with amendments, to read as
follows:

57. Removal of certain infected persons to hospital.

Where any suitable hospital or place for the reception of the sick is
provided, within a convenient distance, any person who is suffering
from any dangerous infectious disease, and is without proper lodging
or accommodation, or lodged in a room occupied by more than one
family, or is on board of any ship or vessel, may, on a certificate
signed by a qualified medical practitioner, and with the consent of
the superintending body of such hospital or place, be removed by
order of any health authority [or justice of the peace] to such hos-
pital or place, at the cost of the city or county in which such case
may occur; and any person who wilfully disobeys or obstructs the ex-
ecution of such order shall be deemed guilty of a misdemeanor, and
shall be fined not less than fifty dollars nor more than two hundred
dollars, or be imprisoned in jail, in the discretion of the [circuit]
court [for the county or Criminal Court of Baltimore], not less than
one month nor more than six months.

62. Removal of body of person who has died of infectious disease.

When the body of anyone who has died of any infectious disease is
retained in a room in which persons live or sleep, or any dead body
which is in such a state as to endanger the health of the inmates of
the same house or room, any health officer [or justice of the peace]
may, on a certificate signed by a qualified medical practitioner or the
application of three persons living in the neighborhood, order the
body to be removed and buried at the cost of the city, town or county,
within a time to be limited by such order, and unless the friends or
relatives of the deceased undertake to bury the body within the time
so limited, and do bury the same, it shall be the duty of the said
health officer [or justice of the peace] to have such body buried at
the expense of the city, town or county, and any person or persons ob-
structing the execution of any order made by any health officer [or
justice of the peace] under this section shall be liable to a penalty not
exceeding two hundred dollars or imprisonment not exceeding six
months.
