of the peace] shall forfeit five dollars, [to] which, if the fine is
imposed by a circuit court of any county or the Criminal Court of
Baltimore, shall
be applied to the use of the county or city as the case
may be.
Notwithstanding anything to the contrary, the provisions
of this section shall not apply:

(1)  To Baltimore County, Prince George's County, or Montgomery
County, or

(2)  To any person who conscientiously believes that the seventh day
of the week ought to be observed as the Sabbath and who actually
refrains from secular business and labor on that day, and whose
business establishment or establishments or employer's business es-
tablishment or establishments (whether a sole proprietorship, part-
nership or corporation) are actually closed on that day; or

(3)  To any person who conscientiously believes that the Sabbath
begins at sundown on Friday night and ends at sundown on Satur-
day night and who actually refrains from secular business and labor
during such period, and whose business establishment or establish-
ments or employer's business establishment or establishments (whe-
ther a sole proprietorship, partnership or corporation) are actually
closed during such period.

§ 540. Witnesses' privileges.

No person shall be excused from attending and testifying, or pro-
ducing any books, papers, or other documents before any court,
[magistrate,] or grand jury upon any investigation, proceeding or
trial, for or relating to or concerned with a violation of any section
of this subtitle or attempt to commit such violation, upon the ground
or for the reason that the testimony or evidence, documentary or
otherwise, required of him by the State may tend to convict him of a
crime or to subject him to a penalty or forfeiture; but no person
shall be prosecuted or subjected to any penalty or forfeiture for or
on account of any transaction, matter or thing concerning which he
may so testify or produce evidence, documentary or otherwise, and no
testimony so given or produced shall be received against him, upon any
criminal investigation, proceeding or trial, except upon a prosecution
for perjury or contempt of court based upon the giving or producing
of such testimony.

§ 551. Issuance; contents; time of search, etc.; disposition of
property seized.

Whenever it be made to appear to any judge of the Supreme Bench
of Baltimore City, or to any judge of any of the circuit courts in the
counties of this State, or to any [justice of the peace in this State]
judge of the District Court, by a written application signed and sworn
to by the applicant, accompanied by an affidavit or affidavits contain-
ing facts within the personal knowledge of the affiant or affiants,
that there is probable cause, the basis of which shall be set forth in
said affidavit or affidavits, to believe that any misdemeanor or felony
is being committed by any individual or in any building, apartment,
premises, place or thing within the territorial jurisdiction of such
judge [or justice of the peace], or that any property subject to
seizure under the criminal laws of the State is situated or located on
the person of any such individual or in or on any such building, apart-
