87-23. Definitions.
As used herein, the following words shall have the meaning
ascribed to them in this article:
(a) "County Refuse Disposal Facilities"—The County incinera-
tor, crematory and sanitary landfill/s.
(b) "Refuse"—All acceptable incinerable and non-incinerable
solid waste, delivered to the County Refuse Disposal Facilities for
disposal by the County and shall include dead animal carcasses
(under 100 pounds).
(c) "Director of Finance"—The Director of Finance of Mont-
gomery County, Maryland and/or his duly authorized agents.
(d) "Director of Public Works"—The Director of Public Works
of Montgomery County, Maryland and/or his duly authorized agents.
(e) "Refuse Collection District"—A special service district es-
tablished June 30, 1969, consisting of certain areas of the County
as denned on maps in the Office of the Director of Public Works, in
which refuse is collected by the County together with all such areas
within the County, which may be added from time to time by the
County Executive, subject to the approval of the County Council.
(f) "Collection Contractor"—A private company under con-
tract with the County to provide refuse collection services to dwelling
units with less than seven units within the Refuse Collection District.
(g) "Dwelling Unit"—A unit in a single-family or multi-
family dwelling located within the "Refuse Collection District" which
is provided refuse collection services by the County.
(h) "Tax Bill"—The real property tax bill prepared by the
Director of Finance for Montgomery County as Collector of State and
County taxes and sent to all persons against whom State and County
real property taxes are assessed.
(i) "Refuse Disposal Charge"—The charge established for use
of the County refuse disposal facilities for disposal of a ton of refuse.
87-24. Billing and Collection of Refuse Disposal Charge.
Refuse Disposal Charge.
(a) A refuse disposal charge is herein established, effective
July 1,1971, at the rate of five dollars ($5.00) per ton for any and all
types of acceptable refuse delivered by any person or agency, public
or private, to the County Refuse Disposal Facilities. The Council may,
by resolution, change such rate for any succeeding fiscal year prior to
July 1 of such year.
(b) The basis for the refuse disposal charges shall be as
follows:
