jurisdiction shall have the right to issue restraining orders, temporary
or permanent injunctions or mandamus or other appropriate forms
of remedy or relief.

Sec. 5. Severability

The provisions of this Act are severable and if any provision,
sentence, clause, section or part thereof is held illegal, invalid or
unconstitutional or inapplicable to any person or circumstances, such
illegality, invalidity or unconstitutionality, or inapplicability shall
not affect or impair any of the remaining provisions, sentences,
clauses, sections or parts of the Act or their application to other
persons or circumstances. It is hereby declared to be the legislative
intent that this Act would have been adopted if such illegal, invalid
or unconstitutional provision, sentence, clause, section or part had not
been included therein, and if the person or circumstances to which the
Act or part thereof is inapplicable had been specifically exempted
therefrom.

Sec. 6. Effective date.

This Act shall take effect on the 76th day following its enactment.
Effective: February 18, 1971

CHAPTER 43

(BILL NO. 1-71)

AN ACT to amend Chapter 1A of the Montgomery County Code
1965, as amended, by repealing and reenacting, with amendments,
subsections 1.5, 1.6, 1.7, 1.8 and 1.9 of Section 1, title "Council
Officers; Secretary and Employees; Duties; Publication and
Records," subsection 2.7 of Section 2, title "Legislative Sessions;
Other Meetings; News Media; Public Participation; Notice; Sign
Limitation; Willful Disturbance," subsection 16.1 of Section 16,
title "Appointments; Confirmation of Appointments," to provide
for the appointment and duties of the Council Staff Director, to
provide that the Secretary and employees of the Council shall
act under the direction of the Council Staff Director and to
provide that the Director notify Council members and the
public of all Council meetings and sessions and to provide that
employees of the Hearing Examiner be appointed by the
Administrative Hearing Examiner.

Be It Enacted by the County Council for Montgomery County,
Maryland,
that—

Sec. 1. Subsections 1.5, 1.6, 1.7, 1.8 and 1.9 of Section 1 of
Chapter 1A, title "County Council" of the Montgomery County Code
1965, as amended, be and the same are hereby repealed and re-enacted,
with amendments, to read as follows:
