2850                            County Local Laws

D member transferring to Group E between July 2, 1970 and June
30, 1971 shall pay retroactive to July 1, 1970 the difference between
the employee contribution rate he paid and seven and one-half (7½%)
percent.

(i) Administrative retirement on or after normal retirement
date. The County Executive only may retire immediately and with-
out cause any County employee member only under his supervision
who has reached his normal retirement date, if in his judgment such
action is justified and demonstratively in the best interest of the
County service and his administration. The decision of the County
Executive may be appealed by the County employee member to the
County Personnel Board whose decision shall be final. Appeal pro-
cedures provided in the Personnel Regulations shall be followed in
making and in handling such appeals. This type of retirement shall
not become effective, in the event the employee does not appeal,
without action of the County Personnel Board whose decision shall
be final. Any such retirement effective May 1, 1970 or thereafter
shall be considered as a separation from the County service in good
standing and without prejudice. Any such retired member who retires
May 1, 1970 or thereafter shall receive a pension commencing im-
mediately and the provisions of Section 94-69(c) "Discontinued Serv-
ice Pension of Employee Members," shall be applicable in deter-
mining the amount of such pension.

(f) "Mandatory retirement date extension."

(4) Each request for an extension must be submitted by the
employee at least sixty (60) days prior to his mandatory retirement
date. In extenuating circumstances the County Personnel Board may
waive the thirty day minimum requirements.

Sec. 2. Sections 65(k), titled "Credited service for prior service
as an elective official as defined in Section 94-61 (f)." and 65 (n),
title "Use of sick leave for obtaining credited service." are hereby
amended and new Section 65(t) title "Credited Service for Period of
Prior County Service." and 65(u), title, "Credited Service for Quali-
fied County Service not credited under the Employees' Retirement
System of the State of Maryland." are hereby added to Section 65,
title "Credited Service", Chapter 94, Montgomery County Code,
1965, to read as follows:

(k) Credited service for prior service as an elective official as
defined in Section 94-61(f). Each member who is an elective County
official as defined in Section 94-61(f) elected for a fixed term as
specifically provided in the Charter of Montgomery County, Maryland
may obtain credited service under the Employees' Retirement System
of Montgomery County for all such service during the period of March
1, 1948 through March 1, 1966. Before the member may be credited
for this service the County shall pay into the Employees' Retirement
