CHAPTER 18
(BILL NO. 43-70)

AN ACT to amend Chapter 73, title "Administration," of the Mont-
gomery County Code 1965, as amended, by repealing and re-
enacting, with amendments, Section 73-24, title "Application,"
Section 73-25, title "Conduct prohibited," Section 73-26, title
"Disclosure and non-participation required; ex parte communi-
cations," Section 73-27, title "Effect of conflict of interests,"
Section 73-28, title "Ethics Commission," and Section 73-30,
title "Penalties" of Article III, title "Conflicts of Interest" to
prescribe by law a Code of Ethics pursuant to Section 411 of
the Charter covering all elected and appointed officers and em-
ployees of the County paid in whole or in part from County
funds, including persons serving on boards or commissions, other
than bi-county agencies, established by law, which provides for
the disclosure of the interest of any person in any matter before
the County government and disqualification of that person from
participating in decisions or other actions in which there is a
conflict between his official duties and private interests; to pro-
vide by law for the establishment of an Ethics Commission, to
establish the authority of the Commission and provide for the
appointment and terms of office of its members; to provide for
the enforcement of the Code of Ethics and to provide penalties
for the violation thereof.

Be It Enacted by the County Council for Montgomery County,
Maryland,
that—

Sec. 1. Article III, Chapter 73, title "Administration," of the
Montgomery County Code 1965, as amended, is hereby repealed and
re-enacted, with amendments, to read as follows:

ARTICLE III CODE OF ETHICS
73-24. Application

The provisions of this Article shall apply to all officers and
employees of the County, whether subject to the personnel merit
system or otherwise, and to the County Executive, Chief Admin-
istrative Officer, the County Council, the County Attorney, the Hear-
ing Examiners, department heads, and all other officers, employees,
and members of boards, commissions, and agencies hired or appointed
by or under the authority of the County Executive, County Council,
or of the County. The words, "official" or "officials" as used in this
Article shall not apply to members of bi-county agencies created by
State law.

73-25. Conduct prohibited,
a. No official shall:

(1) Decide or participate in a decision in which he has a
financial interest, as owner, member, partner, officer, employee, stock-
