CHAPTER 13

AN ACT to amend Chapter 109, title "Weapons," of the Montgomery
County Code 1965, as amended, by repealing and re-enacting,
with amendments, Section 109-10, title "Penalty for violations of
chapter," to delete an obsolete provision requiring the County
Manager to approve "Notice of Violation" forms.
Be It Enacted by the County Council for Montgomery County,
Maryland, that—
SEC. 1. Section 109-10, Chapter 109, title "Weapons," of the
Montgomery County Code 1965, as amended, is hereby repealed and
re-enacted, with amendments, to read as follows:
109-10. Penalty for violations of Chapter.
Except as otherwise provided in Section 109-2 of this Code, any
person who shall violate any of the provisions of this Chapter, or of
the conditions of an approval certificate issued hereunder shall, upon
conviction thereof, be punished by a fine of not to exceed one thousand
dollars or imprisonment of not to exceed one hundred eighty days in
jail. Any County police officer witnessing a violation of this Chapter
may, as an alternative to making an arrest, issue unto said violator
a "Notice of Violation," which notice, in addition to such factors as
may otherwise be required, shall specify the violation with which said
violator is charged and shall set forth the hour, date and location
that said violator is summoned to appear before the People's Court
for Montgomery County, Maryland, to answer said charge.
Sec. 2. Effective date.
This Act shall take effect on the 76th day following its enactment.

CHAPTER 14
(BILL NO. 36-70)
AN ACT to amend Chapter 47, title "Montgomery County Suburban
District," of the Montgomery County Code 1965 by amending
Section 47-2, title "Council designated as district council; powers;
penalties for violations of regulations, etc.," to provide that the
County Council may, by law, authorize the County Executive to
set the rate of license fees; promulgate reasonable regulations for
vehicular control on streets within the district; to authorize the
County to condemn property within the Montgomery County Sub-
urban District for public purpose; to provide that the Council
