Sec. 2. Nothing contained in this Act shall be construed as im-
pairing the validity of any proceeding or action taken pursuant to
the Sections of the Montgomery County Code repealed by this Act
prior to the effective date of this Act.
Sec. 3. This Act shall take effect on the 76th day following its
enactment.

AN ACT to amend Chapter 2, title "Administration," of the Mont-
gomery County Code 1965 by repealing and re-enacting, with
amendments, Section 2-65, title "Generally," of Article IX, title
"Department of Health"; to amend Chapter 88, title "Health
and Sanitation," by repealing in its entirety Section 88-7, title
"Direction; appointment, etc., of health officer," of Article II,
title "Department of Health," to provide for the appointment
of the County Health Officer by the County Executive, subject
to the confirmation of the Council; to provide that the Depart-
ment of Health shall have such functions as the County Execu-
