SEC. 15. Section 24-32, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed in its en-
tirety and a new Section 24-32 is hereby added in lieu thereof to read
as follows:

24-32. Same—Public hearing required prior to authorization of con-
struction and assessment of benefits; notice; publication.

(a)    Before any road construction shall be authorized, a pub-
lic hearing thereon shall be held by the County Executive or his
designee. Any interested person shall be entitled to appear and be
heard at such hearing. Notice of such hearing shall be sent by certi-
fied or registered mail, at least two weeks before the scheduled date
of the hearing, to the owners of the property subject to assessment
for the proposed construction as listed in the records of the Depart-
ment of Finance.

(b)    All notices issued pursuant to this Section shall contain
the following:

(1)    The time and place of the hearing;

(2)    The location of the construction which is the subject
of the hearing;

(3)    The extent and kind of construction intended;

(4)    The type of materials to be used;

(5)    The estimated cost of construction;

(6)    Identification of the real property that there is reason
to believe will be benefited by the construction.

(c)    A summary of the notice provided for in this Section
shall be published twice in a newspaper of general circulation in the
County before the scheduled date of the hearing. Such summary shall
include a statement indicating where a full copy of the text may be
obtained.

SEC. 16. Section 24-33, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed in its en-
tirety and a new Section 24-33 is hereby added in lieu thereof to read
as follows:

24-33. Same—Authorization of construction; recommendation of as-
sessments to Council; contents.

(a) If, after the hearing provided for in Section 24-32 of
this Code, the County Executive shall find that the public interest
requires that any road construction project under consideration, or
any portion thereof, be carried out, he shall, by written order author-
ize such construction or portion thereof in conformity with the Mont-
gomery County Road Construction Code in force at the time.
