the ground even though other facilities may be placed underground in the
area. However, any such permission shall be upon such conditions as the
Director of Public Works may require for the public welfare. Any facili-
ties of the Grantee placed underground at the property owners request,
in an area where electric and telephone facilities are aerial, shall be in-
stalled with the additional expense paid by the property owner.

(i) In the case of disturbance of any street caused by the Grantee,
the Grantee shall at its own cost and expense and in a manner approved
by the Director of Public Works of Howard County replace and restore
such street, in as good a condition as before the work involving such dis-
turbance was done.

(j) The Grantee shall upon the request of any person holding a build-
ing moving permit issued by Howard County, temporarily raise or lower
its wires to permit the moving of buildings. The expense of such temporary
removal or raising or lowering of the wires shall be paid by the person
requesting the same and the Grantee shall have the authority to require
such payment in advance. The Grantee shall be given not less than seventy-
two (72) hours advance notice to arrange for such temporary wire changes.

14.709. Supervision by Howard County.

(a)  The Grantee shall construct, operate and maintain the CATV
system, subject to the supervision of all the authorities of Howard County
who have jurisdiction in such matters and in strict compliance with all
laws, ordinances, and departmental rules and regulations affecting the
CATV system.

(b)  No construction, reconstruction or relocation of the Community
Antenna Television System, or any part thereof, within the streets shall
be commenced until written permits have been obtained from the proper
Howard County officials, such permit so issued containing conditions and
regulations from time to time imposed.

(c)   Community Antenna Television System and all parts thereof,
shall be subject to the right of periodic inspection by Howard County.

(d)  The Director of Public Works may, from time to time, issue such
reasonable rules and regulations concerning the construction, operation,
and maintenance of the Community Antenna Television as are consistent
with the provisions of this Act and with the approval of the Council.

(e)  The company shall undertake any construction and installation
as may be necessary to keep pace with the latest developments in the
state of the art, whether with respect to increasing channel capacity, fur-
nishing improved converters, instituting two-way services, or otherwise.

(f)  If at any time the powers of the Council or any agency or official
of Howard County are transferred by law to any other board, authority,
agency, or official, then such other board, authority, agency, or official
shall have the powers, rights and duties previously vested under this Act
in the Council or any agency or official of Howard County.

(g)  Within two months of the effective date of this Act, there shall
be created a "CATV Service Advisory Committee" whose function shall
be to advise the County Executive and County Council on all matters
related to the use of cable communications systems and facilities. The
Committee shall consist of 5 members appointed by the County Executive
and confirmed by the County Council. Rules and regulations governing the
Committee operations and its duties and functions shall be prescribed by
directive of the Executive.
