relocated or closed.

Section 1. Be it enacted by the County Council of Howard County,
Maryland,
That Section 16.102 of the Howard County Code be and it is
hereby repealed and re-enacted, with amendments, to read as follows:

16.102—Street Plan, Recordation

When a major street plan for Howard County or a portion thereof,
shall have been adopted, and a certified copy of such plan shall have been
filed in the Office of the Clerk of the Circuit Court for Howard County,
then no plat of a subdivision of land within said Howard County or part
thereof, shall be filed or recorded until it shall have been approved by the
Office of Planning and Zoning, and such approval entered in writing on
the plat by the Director of Planning. THE STREETS AND ROADS
SHOWN ON A MAJOR STREET PLAN (SOMETIMES CALLED THE
GENERAL PLAN OF HIGHWAYS FOR HOWARD COUNTY) WHICH
HAS BEEN ADOPTED AND FILED SHALL NOT BE REMOVED
THEREFROM, RELOCATED, OR NEW STREETS OR ROADS ADDED
THERETO, EXCEPT THOSE WHOLLY WITHIN ANY SUBDIVISION
PROPOSED IN ACCORDANCE WITH THESE REGULATIONS. UN-
LESS THERE HAS BEEN COMPLIANCE WITH REQUIREMENTS
OF SECTION 18.304(d) RELATING TO NOTICE TO PROPERTY
OWNERS WHOSE PROPERTY IS CONTIGUOUS WITH ANY
STREETS OR ROADS REMOVED FROM THE PLAN, RELOCATED
OR ADDED THERETO.

Section 2. Be it further enacted by the County Council of Howard
County, Maryland,
That this Act shall take effect sixty (60) days after
its enactment.

This Bill, having been approved by the Executive and returned to the
Council, stands enacted on March 8, 1971.

An Act to repeal and re-enact with amendments, Section 18.304 of
the Howard County Code relating to the relocation or closing of pub-
lic roads to require notice to property owners of any proposed reloca-
tions or closing of a County road and to prohibit the opening,
relocation or closing of a County road except by Resolution duly
adopted by the County Council of Howard County.

Section 1. Be it enacted by the County Council of Howard County,
Maryland,
that Section 18.304 be and it is hereby repealed and re-enacted
with amendments to read as follows:

Section 18.304—Relocation or Closing of Public Roads

(a) No County road shall be closed or relocated except by resolution
of the Howard County Council adopted in accordance with the provisions
of this section. For the purposes of this section any improvement or
alteration wherein a new road fails to overlap or be contiguous with the
previously existing road shall be considered to be a relocation of said
road.
