Subtitle, to be under the new Article V, "Franchises", to read as
follows:
Section 12-1715.
For the purposes of this Article, the following terms, phrases,
words, and their derivations, shall have the meaning given herein.
When not inconsistent with the context, words used in the present
tense include the future, words in the plural number include the
singular number, and words in the singular number include the
plural number. The word "shall" is always mandatory and not
merely directory.
(1) "Cable Television System" means a system for the trans-
mission of visual and/or audio signals by means of electrical
impulses over coaxial cables or other suitable means, consistent with
the services being offered and the state-of-the art within the in-
dustry.
(2) "Council" means the County Council of Anne Arundel
County.
(3) "County" means Anne Arundel County, Maryland, a body
corporate and politic, and/or the geographical area comprising
Anne Arundel County, Maryland, or both, as the context requires.
(4) "Franchisee" means the grantee or rights under this
franchise.
(5) "Northern franchise district" means that geographical
portion of Anne Arundel County north of the John Hanson Highway
(U.S. Route No. 50).
(6) "Person" means any person, firm, partnership, association,
corporation, company or organization of any kind.
(7) "Southern franchise district" means that geographical
portion of Anne Arundel County south of the John Hanson Highway
(U.S. Route No. 50).
(8) "Subscriber" means any "person" so described in part (6)
who purchases service from the "franchisee". The person may
purchase any or all of the services which the franchisee may provide.
Section 12-1716.
(a) A non-exclusive franchise is hereby granted to Chesapeake
Antenna Television, Inc. NORTH ARUNDEL CATV, INC. for the
Northern franchise district, subject to the provisions of this Article.
(b) A non-exclusive franchise is hereby granted to United
CATV, Incorporated INC. for the Southern franchise district, subject
to the provisions of this Article.
(c) Subject to other applicable County law (if any), the
franchises may erect a tower and associated reception facilities and
transmission equipment in a geographical portion of Anne Arundel
County outside of the franchise district; provided, that no subscribers
